Page 9 #18 . Inspections <br /> The applicant objects to this as" unreasonable and <br /> unnecessary, " as he is already regulated by Dane County , <br /> EPA, DILHR. OSHA, and the Bureau of Mines . He states that <br /> additional regulations by the Township is superfluous , <br /> duplicitous and unnecessary. In addition, the Town Board has <br /> no regulatory expertise . <br /> Comment : It is well known that most large governmental <br /> inspectors inspect infrequently. A function of local <br /> government is to be near , present and responsive . Since the <br /> local town officials know the conditions of the CUP they can <br /> ' easily ascertain whether the owner/applicant is in <br /> compliance and if needs be , call in other experts for <br /> consultation.We urge that you include this in your <br /> recommendations for this CUP. <br /> Page 11 , #24 Liability Insurance <br /> In our litigious society <br /> when a suit is brought by a party , all parties which have <br /> any remote connection with the party being sued are also <br /> sued . The Township should not have any monetary liability <br /> should there be any litigation concerning this quarry. <br /> Precedence can be found for this liability insurance in CUP <br /> 1021 ,and is common in most large activities of this sort . <br /> #25 If the applicant is sure that there will be no <br /> litigation concerning this quarry then. the hold/harmless <br /> should be an easy agreement . <br /> We wish to support the recommendation of the Town Board . <br /> Page 11 , #23 Re-application : The Citizens for Rural Land <br /> Preservation do not agree with this condition and want to <br /> keep the original first 4 recommendations made by the Town <br /> Board as to the size limitation of the CUP, as noted on <br /> pages 1 and 2 of the applicant ' s response document . <br /> Except for this last exclusion, the Citizens for Rural Land <br /> Preservation support the Town Board ' s conditions for this <br /> CUP. We wish to remind you again, that we do not want this <br /> CUP to be passed at all . The remainder of the Town Board <br /> conditions are acceptable to us . <br /> J <br /> LYN NTP1/444 <br />
