I <br /> The applicant objects to the berming as unnecessary and <br /> duplicitous . <br /> Comment : The use of berms is wide spread and used around <br /> noise sources , dust sources and around areas which are not <br /> aesthetically pleasing. Berms have been included in other <br /> CUPs , (example: CUP 1159) ,and are generally considered more <br /> pleasing , and less expensive than fencing. Berms cannot be <br /> equated with trees and consequently are not duplicitous . <br /> They form a complimentary barrier , each doing their own job. <br /> Page 8 , #14 : Hours of operation <br /> The applicant states that this is "way too severe and not <br /> necessary. " <br /> Comment : There are two sets of reasons to limit the hours <br /> for this quarry. 1 ) the proximity to Rockdale , where <br /> citizens wish to carry on a normal life style , especially on <br /> weekends without the noise of crushing , and blasting and the <br /> traffic on adjacent roads , and 2) the proximity to Cam Rock <br /> Park , where picnics , weddings , wedding receptions , meetings <br /> and organized and unorganized recreation and sports take <br /> place in the evenings and during the weekends . <br /> Here is a sterling example of Item 2 on the Finding of Facts <br /> issued for each CUP. . . "that the uses , values and enjoyment <br /> of other property in the neighborhood for purposes already <br /> permitted will not be substantially impaired or diminished <br /> by the establishment , maintainance and operation of the <br /> proposed conditional use" Surely blasting interrupting the <br /> wedding vows would substantially impair the ceremony. We <br /> urge you to adopt the hours of operations recommended by the <br /> Town Board . <br /> Page 8 , #15 The Town Board recommends that the site be used <br /> for agricultural lime and gravel only. We strongly support <br /> this recommendation and urge you to adopt it . <br /> Page 9 #16 , Well Testing: <br /> The applicant object to this as it doesn' t specify what is <br /> to be tested for or what effects on the wells is prohibited . <br /> In addition, he states that this is unnecessary since there <br /> will be no effect on the ground water in accordance with the <br /> hydological study done in conjunction with this conditions <br /> use permit . <br /> Comment : The testing is to assure that there is no <br /> contamination from mineral extraction operation. As of <br /> October 15 , 1995 the Town Board had not received any <br /> hydological study from the applicant . <br />
