DANE COUNTY ORDINANCE AMENDMENT NO. 6388 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> Dunkirk <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Dunkirk be amended to <br /> include in the C-2 Commercial District/s the following described <br /> land: <br /> Pet. #6388: <br /> Part of the NE 1/4 NE 1/4 of Section 11, Town of Dunkirk described <br /> as follows: Commencing at the the Northeast corner of said Section <br /> 11; thence S 00° 46' East along the East line of said 1/4 1/4, <br /> 133. 6 feet to the point of beginning; thence continue S 00° 46' <br /> East, 532 feet; thence S 89° 00' West, 1314 feet to the West line <br /> of said NE 1/4 NE 1/4; thence N 00° 46' West along said West line, <br /> 570 feet to the South line of USH 51; thence S 88° 24' East, along <br /> said South line, 405 feet; thence N 83° 04' East along said South <br /> line, 704 feet; thence S 63° 58' East along said South line, 196 <br /> feet; thence S 87° 22' East 33 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 <br /> (3) (a) 2. (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for <br /> which a certified survey map will be prepared for approval and <br /> recorded. This amendment will become effective, if within 90 days <br /> of its approval by Dane County, a certified survey map that <br /> describes the land to be rezoned is recorded in the office of the <br /> Dane County Register of Deeds. Failure to record the survey will <br /> cause the rezone to be null and void. Two copies of the recorded <br /> survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on said land: <br /> 1 . That there be no further subdividing of the property. <br /> Said restriction shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of land within 300 <br /> feet of the site. Failure to record the restrictions will cause <br /> the rezone to be null and void. <br />
