PLANNING& DEVELOPMENT <br /> Robert Holzhueter/Danco Prairie FS Coop ZONING DIVISION <br /> Dear Mr. Gregorius, <br /> This letter is to clarify the town position on Zoning Petition #6388. The Town Board of the Town <br /> of Dunkirk approved AB Zoning for 10 acres on 18 March 1996. This has not changed. Danco FS <br /> no longer wishes to store at and sell from the site the petroleum and LP products originally requested. <br /> Thus AB zoning is proper for the Ag business as granted by the Town on 18 March 1996. (Copy of <br /> the Town Board Action Report, signed by me on 18 March 1996, is included.) The 18 March 4 <br /> approval by the Town included the following conditions. <br /> 1. The area is 10 acres; <br /> 2. The C-2 zoning is changed to AB (no fuel operation); <br /> 3. Danco FS will abide by all current and future regulations re. fertilizer, feed and <br /> pesticide handling; <br /> 4. Danco FS will work with State, County and Township for road improvements needed <br /> 5. Danco FS will use USH 51 for heavy loads where possible; and <br /> 6. Danco FS will work with neighbors to develop sight and sound barriers <br /> At last night's Town Board meeting(6 August 1996),the town added the following three conditions: <br /> 1. That there be a deed restriction providing for no further subdividing of the property; <br /> 2. That there be an indemnification agreement re. damage to Tower Drive, with the <br /> Town deciding if damage has occurred; and <br /> 3. that a landscaping agreement be made with Danco FS working together with the <br /> neighbors, the Town Board being the mediator of such an agreement, including the <br /> concern about a Danco FS sign. <br /> The third condition modifies condition #6 approved at the 18 March 1996 Town Board meeting and <br /> should further satisfy concerns re. condition #6 expressed by the Zoning and Natural Resources <br /> (ZNR) committee earlier this year when it considered the AB zoning request.
