b. With respect to the driveway located at Point F as shown on the Plan, <br /> which is currently the sole access to both the Stoughton Garden Center business and the <br /> G & N Landscaping business now located on Lot Three (3), CSM 5906, the parties agree <br /> that the same will be kept open and available for use by owners, employees and the <br /> general public who currently use the same for IHIighway 51 access to Lots Two (2) and <br /> Three (3), CSM 5906, for a transitional period extending from the date of execution of <br /> this Agreement. until eleven months after the opening of the new Stoughton Garden Center <br /> referred to in subparagraph 13a above, or December 31, 1996, whichever comes first. <br /> c. Gary J. Dvorak and Nancy J. Dvorak shall, at their expense, build a <br /> fence with a gate to limit access by the public from the driveway referred to in <br /> subparagraph 13b above to the Stoughton Garden Center. Said fence will be located <br /> entirely on l,ot. Three (3), CSM 5906 sufficiently far from the driveway so as not to <br /> interfere with snow removal. <br /> d. The Town shall allow appropriate signing at the current access to <br /> Stoughton Garden Center and at the southerly entrance to the frontage road referred to in <br /> subparagraph 13a above, to inform the public of the relocation of the access to the <br /> Stoughton Garden Center. • <br /> e. Following the transitional period referred to in subparagraph 13b <br /> above, use of the driveway referred to in subparagraph t 3b above by retail customers of <br /> Stoughton Garden Center will not he permitted. <br /> 14. This Development Agreement does not in any way relieve Robert II. <br /> Dvorak, Jr., Laurie J. Dvorak, Gary J. Dvorak or Nancy J.
