A ' <br /> Compliance with Town of Oregon Land Use Plan <br /> The Town of Oregon Board recommended denying the Congregation's request <br /> for a conditional use permit on the grounds that it did not meet the criteria stated <br /> in the town's land use plan, specifically sections 3 d, e, h, i and 4 g of the Oregon <br /> Land Use Plan. (See page 19 of Oregon Town Use Plan.) Citations from the Land <br /> Use Plan and the Congregation's responses follow: <br /> Town Use Plan-3-d). The land does not include important natural features <br /> such as wetlands, floodplains, steep slopes, significant woodlands, etc. which <br /> would be adversely affected by non farm development. <br /> Response to Concerns— This property does not contain significant floodplains <br /> or steep slopes. It does contain wetlands and woodlands. The Congregation <br /> plans to leave the wetlands undisturbed. Further, the proposed structures would <br /> be on the higher ground in the woods. Wherever possible, existing open spaces <br /> would be utilized rather than clearing any area for building. Building would be <br /> low impact and provide for the continued preservation of the existing woodlot. <br /> Town Use Plan-3-e). The lay of the land will allow for construction of a road or <br /> driveway that is suitable for emergency vehicle travel. Safe access for the road or <br /> driveway onto existing roadways shall be required. <br /> Response to Concerns—The Oregon Plan Commission expressed concerns that <br /> the driveway leading to and through the property was not adequate. The existing <br /> driveway serves a home at the end of the drive. There have been no safety <br /> concerns raised about this house because of its drive. <br /> Since, according to p. 33 #11 of the Oregon Land Use Plan, "All driveways <br /> should be reviewed and jointly approved by the Oregon Area Fire Department, <br /> Town Engineer and the Town in order to ensure safe and adequate access to and <br /> from the site," we can only assume that this driveway meets county guidelines <br /> for safe and adequate access emergency vehicles. <br /> The driveway which leads into and through the property is of a similar quality <br /> with the majority of driveways to rural homes and farms in the area. Farms <br /> with similar access have many more structures at risk than the proposed <br /> development and are also located near wetlands areas. (See Appendix B for <br /> structure plans). Based on the arguments given by the Plan Commission <br /> regarding this issue many of these farms and homes are also at risk. <br /> Since many of the rural residences and farms in the area have similar <br /> driveways, it seems that this issue does not actually address a legitimate concern <br /> but was raised in an effort to discourage the Congregation from purchasing the <br /> property. <br /> Town Use Plan-3-h). Provision of public facilities to accommodate the <br /> proposed development will not place an unreasonable burden on the ability of <br /> the Town of Oregon to provide those facilities.
