February 13, 1995 <br /> Page 2 <br /> (3) Town Supervisor Ken Ziegelbauer disqualify himself and <br /> refrain from participating as a Town Supervisor in any debate and <br /> vote in regard to this petition. <br /> This statement is submitted in support of these requests and <br /> approval of this petition. <br /> B. Factual Background <br /> (1) Relevant History of The Parcel <br /> This parcel is the uneconomic remnant of the farm once <br /> known as the Albert Stoppleworth Farm. It is one of two parcels <br /> created by a January 3 , 1980, land division of the 5 . 75 acre <br /> remnant of the Stoppleworth Farm. The Stoppleworth Farm was split <br /> by U.S. Highway 14 so that approximately 214 acres, together with <br /> virtually all of the productive farmland and the barn and sheds, <br /> formerly were north of Highway 14 . Approximately 5 . 75 acres of <br /> nonproductive farmland and a house formerly were south of Highway <br /> 14. The 214 acres of the Stoppleworth Farm lying north of the <br /> highway was sold for residential development on or about May 15, <br /> 1978 and platted as Oak Valley Estates on or about October 15, <br /> 1980. That remnant of the Stoppleworth Farm lying south of Highway <br /> 14 was sold to Cyril and Caroline Virnig by the Estate of Albert <br /> Stoppleworth in 1982 . Prior to both the effective date of A-1 <br /> Exclusive Agriculture zoning and the time the Virnigs bought the <br /> Stoppleworth Farm remnant, this parcel was not suitable for <br /> farming. The topsoil was stripped from this parcel and it was <br /> quarried during the late 1970' s . <br /> (2) Relevant History of Rezone Petition No. 5898 <br /> Rezone Petition No. 5898 was filed on behalf of the <br /> former owners, Cyril and Caroline Virnig, on or about February 25, <br /> 1994 . Petition No. 5898, as amended, sought to rezone the easterly <br /> 245 feet of the subject parcel to LC-1 Commercial District from A-1 <br /> Agriculture District (Exclusive) and the westerly 324 of the <br /> subject parcel to A-B Agriculture District from A-1 Agriculture <br /> District (Exclusive) . The Town Board conditionally approved <br /> Petition No. 5898 on May 16, 1994, by a two to one vote. Town <br /> Supervisor Ken Ziegelbauer was the only vote against Petition No. <br /> 5898 at the town level . The Zoning Committee conditionally <br /> approved Petition No. 5898 on June 28, 1994, by a vote of 5 to 2 . <br /> The Dane County Board of Supervisors adopted Petition No. 5898 on <br /> July 21, 1994, by a 22 to 15 vote, but County Executive Richard <br /> Phelps vetoed Petition No. 5898 on August 18, 1994. The Dane <br /> County Board of Supervisors failed to override the veto. <br />
