• e. the minimum hours of retail garden center operations shall be as established from time to time in the owner's discretion, but the maximum hours of retail operation shall not exceed 8:00 a.m. until 8: 00 p.m. f. all security lighting on site shall be shielded and directed downward similar to street lighting. g. street trees or shrubs shall be planted by the Owner along the public right-of-way of Stage Coach Road abutting the subject parcel . The cost of the initial planting of street trees or shrubs shall be borne by the Owner. When the Owner proposes the installation of street trees or shrubs he shall prepare a report listing the street trees or shrubs to be planted and their location for approval by the Town. The Owner shall replace any diseased or destroyed street trees or shrubs planted by the Owner hereunder and abutting the subject parcel provided that adequate space for tree or shrub growth is available. h. the on site development or use shall not violate any applicable air pollution, water pollution or soil erosion state or local standards. The Dane County Zoning Committee having considered the Town Board's actions respecting Petition #6200, including its finding respecting the consistency of the proposed uses with the land use plan of the Town of Cross Plains, the relevant history of the subject parcel, the proposed uses of the subject parcel, the compatibility of the proposed uses with the surrounding uses, the benefits to the community arising from the proposed uses of the subject parcel, all the petitions submitted in support and opposition to Petition #6200, all the arguments made in support and opposition to Petition #6200, including the supporting statement submitted on behalf of Mr. Niesen, and those conditions or restrictions, if any, on the proposed uses deemed necessary for approval of Petition #6200. R E S O L U T I O N RESOLVED, that Petition #6200 is hereby approved subject to the following changes: 1. That the Zoning District Maps of the Town of Cross Plains be amended to include in the LC-1 Limited Commercial and Ab Agri Business Districts the following described land: x , TO LC-1: The Westerly 245 feet, more or less, of Lot #1, CSM 3394, found in Volume 13, Page 200 of Certified Survey Maps, Dane County Register of Deeds Office.
