This proposed commercial landscape and garden center business conflicts with <br /> agricultural preservation area policies of the Town of Cross Plains. This site is vacant with single <br /> family homes to the east, west and north across Hwy. 14. There is a larger, mineral extraction <br /> site to the south. <br /> The relevant adopted town/county policy is: "Only commercial uses clearly needed to support <br /> agricultural production may be permitted to rezone in designated agricultural preservation areas. <br /> Also small family owned and operated businesses that provide a service to the community may be <br /> permitted with any restriction deemed necessary by the Town Board. Only that portion of land <br /> necessary for the contemplated use will be rezoned if all other policies are met." <br /> Comments: <br /> • A landscape contractor and garden center would serve a more urban population, <br /> and they generally are not involved with agricultural production. <br /> • If this is to be a small family owned business, it should have the limits of a <br /> "limited" family business. If it is a larger business, it clearly conflicts with the <br /> policy. <br /> • It is near Black Earth Creek, which needs protection from surface runoff and <br /> fertilizers. <br /> • If this site is rationalized for approval, it needs specific limits. Additional <br /> conditions should address: <br /> - Construction erosion control <br /> - Stormwater management, including parking areas <br /> - Adequate safeguards for any potential fertilizer or pesticide spills <br /> - Screening or landscape treatment to minimize visual impacts from Hwy. <br /> 14 and residential neighbors. <br /> The Dane County Park and Open Space Plan designates a preservation area along the Upper <br /> Black Earth Creek. This area, including the subject property, is to be studied for water quality <br /> protection of the Black Earth Creek since it is so close to the creek. The western half of the <br /> property has been identified as a potential trail corridor by the Ice Age Trail Foundation and the <br /> Department of Natural Resources. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> DANE COUNTY HIGHWAY <br /> OTHER <br />
