CUP 1226, St- Brothers, Town of Bristol, 3/14/95 Motio. Salkin/Kesterson to impose the following conditions: 1. Wingra Stone Company will submit a plan of operation for fugitive dust control to Mr. Thomas Roushar of the DNR southern district Air Management section and will allow onsite review of operations by the Department of Natural Resources. 2. Wingra Stone Company will route stormwater away from Patrick Marsh. The company agrees to seed and mulch stockpiled overburden to minimize erosion to the marsh, and to maintain the existing trees along the west property line as an aesthetic buffer. 3. Wingra Stone Company will maintain a 30 foot setback on mineral extraction from the west property line and otherwise prevent encroachment upon the 100 foot shoreland zone of Patrick Marsh (measured from the 965.5 foot NGVD contour) 4. Wingra Stone Comapny will employ above-ground fuel storage facilites equiped with spill containment devices to minmize the possibilty of groundwater contamination. 5. Wingra Stone Company will restrict mineral removals to material above 965.5 feet NGVD elevation to avoid pumping that may lower Patrick Marsh water levels. 6. Wingra Stone Compnay will maintain a blasting schedule not exceeding 3 shots per day, or 90 shots total, during each of the March-May and September-Novemeber waterfowl migration and nesting seasons. Motion by Salkin/Kesterson to find that the standards of the zoning ordinance are met and to approve the Conditional Use Permit 1226 as conditioned; carried 7-0. V. PLATS:
