(b) the volume of play and use of facilities by the public <br /> shall decrease proportionately as the number of equity <br /> memberships increase; <br /> (c) during the period of membership development and after, <br /> only full, equity members of the Bishop's Bay Country <br /> Club and their guests will have access to any of the <br /> other facilities, including dining and club membership <br /> facilities in the Bishop's mansion, tennis facilities, <br /> swimming facilities, visitor pier, or any other portions <br /> of the Country Club grounds lying between CTH M and Lake <br /> Mendota (except the golf course and the pro shop) . <br /> After the equity membership of the Club reaches or exceeds two <br /> hundred fifty (250) members, the course, driving range, and <br /> putting greens, and golf-related facilities will be required <br /> to be used exclusively and solely by the equity members and <br /> guests of the private country club. The Bishop's Bay Country <br /> Club premises will be used in such a manner, and to such an <br /> extent, that does not differ materially from the uses allowed <br /> at the three private country clubs in Dane County (Blackhawk <br /> Country Club, Maple Bluff Country Club and Nakoma Country <br /> Club) ; <br /> The Bishop's Bay Country Club will maintain equity membership <br /> requirements at least as restrictive as the membership <br /> standards of the three private country clubs in Dane County <br /> (Blackhawk Country Club, Maple Bluff Country Club and Nakoma <br /> Country Club) ; i <br /> In the event that the 18-hole golf course construction is not <br /> commenced within three years of the enactment of this <br /> ordinance and amendment, the town may petition to rezone the <br /> RE-1 and B-1 zoning districts to the R-1 zoning district that <br /> existed prior to this amendment. In the event construction is <br /> prevented by court action, the time for commencement of <br /> construction shall be extended until the court order <br /> preventing such construction no longer is in force. <br /> In the event of any conflict between this Paragraph 4 and any <br /> other provision contained in this document, the provisions of <br /> this Paragraph 4 shall control. <br /> 5. These restrictions set forth at Paragraphs 3 and 4 hereof <br /> shall constitute covenants running with the land and shall be <br /> binding upon all parties now owning any part of said land, <br /> their successors, heirs and assigns, and all parties holding <br /> under them unless, pursuant to Paragraphs 8 or 9 of this <br /> instrument, said restrictions are amended or terminated. <br /> 6.
