j . cart paths/walking paths/driveways/parking <br /> areas/and similar pedestrian and vehicle ways for <br /> the exclusive use of the members and guests of the <br /> country club; <br /> k. uses customary and normal to supporting the private <br /> golf course and private country club usage, as <br /> currently defined, or as may become customary to <br /> such permitted uses in future for the exclusive use <br /> of the members or their guests. <br /> 4. It is the intention of the parties that a private golf course <br /> and associated country club facilities will be constructed on <br /> the above-described premises. Said golf course and the <br /> associated country club facilities shall be used exclusively <br /> by the members thereof and their guests. In the event that <br /> the premises zoned B-1 and the entire golf course and the <br /> facilities thereon cease to be used exclusively and solely for <br /> the use of its members and guests as a private country club <br /> (except as provided for in this document) , Sam Jacobsen for <br /> himself, his heirs and his assigns does hereby appoint the <br /> Town of Westport as his agent for the purpose of filing a <br /> petition with the proper zoning authority to rezone the entire <br /> premises south of County Trunk Highway "M" to R-1 zoning as <br /> existed upon said premises immediately prior to the change in <br /> zoning for said premises to RE-1 and B-1. The Town of <br /> Westport, as agent for said Sam Jacobsen, shall have the <br /> authority to do and perform all acts necessary to accomplish <br /> said rezoning. Further, in the event that actual golf course <br /> construction is not commenced within three years of the <br /> enactment of this ordinance and amendment, the Town may <br /> petition for said rezoning in the manner set forth herein for <br /> purposes of this Paragraph. The premises shall cease to be <br /> used exclusively and solely for the use of its members and <br /> guests as a private country club when such premises are used <br /> by the general public in a less restrictive manner from the <br /> use of Nakoma Country Club, Blackhawk Country Club and Maple <br /> Bluff Country Club. <br /> Notwithstanding the foregoing, until the earlier of the <br /> expiration of 5 years from the date hereof or such time as Sam <br /> Jacobsen or his assignee sells at least two hundred fifty <br /> (250) equity memberships (period of membership development) , <br /> public usage of the golf course, driving range, and putting <br /> greens shall be permitted on a selective basis, subject to the <br /> following conditions: <br /> (a) the owner will adopt and enforce dress code restrictions <br /> for the golf course which are consistent with those of <br /> any of the privately-owned country clubs in Madison, <br /> Wisconsin; <br /> -3- <br />
