d. pro-shop and related sales incidental to the <br /> operation of the private country club; <br /> e. swimming pools, bath house and similar supporting <br /> facilities for the exclusive use of the members and <br /> guests of the private country club; <br /> f. tennis club facilities, including outdoor and <br /> indoor tennis courts for the exclusive use of the <br /> members and guests of the private country club; <br /> g. health club facilities and other recreation <br /> facilities for the exclusive use of the members and <br /> guests of the private country club; <br /> h. visitor pier and other marine facilities allowing <br /> normal and customary use of Lake Mendota subject to <br /> the following restrictions: <br /> The pier to be built on Developer's Property shall <br /> conform physically in all respects to the rules of <br /> the DNR. Said pier shall be for the use only of <br /> country club members and shall not be available for <br /> the use of the general public. No repairs or sales <br /> of any items shall be allowed on the pier or <br /> elsewhere on the waterfront on Developer's <br /> Property. There shall be no boat storage either on <br /> the waterfront on Developer's Property or on the <br /> pier to be constructed thereon for any purpose. <br /> Dockage shall be limited to the hours of 8: 00 a.m. <br /> to 11:00 p.m. , except that the Country Club shall <br /> be allowed to keep one boat at said pier at all <br /> times. Nothing in this Agreement shall prevent a <br /> riparian owner from utilizing said waterfront for <br /> his or her own personal use. This exception shall <br /> not apply to persons who are not riparian owners <br /> and claim the right to use said waterfront through <br /> a riparian owner. For purposes of this <br /> restriction, a person holding an easement or other <br /> right to travel to or from the waterfront over the <br /> lands of a riparian owner shall not be considered <br /> to be a riparian owner. There shall be no <br /> launching facilities provided on Developer's <br /> waterfront. Any changes or modifications in the <br /> use of Developer's waterfront shall be made only <br /> with the consent in writing of the Town Board. <br /> At no time shall there be more than 20 boats tied <br /> to said pier nor shall there be more than 3 boats <br /> on swing moorings located in the water in front of <br /> said waterfront. <br /> i. private golf course, putting greens, driving ranges <br /> and similar practice facilities for the exclusive <br /> use of the members and guests of the country club; <br /> -2- <br />
