J <br /> Westport Quarry Condition Use Permit <br /> 1. We are seeking a Condition Use Permit to permit mining, <br /> blasting and mineral extraction for a small parcel of property <br /> south of the site of an existing permit for which a separate <br /> permit has been issued. <br /> 2 . We want to do the blasting and extraction in this area to <br /> remove a 50 foot cliff that currently exists. The blasting <br /> will permit us to provide for a sloped gradient. We doing <br /> this to remove what might be a public safety hazard. <br /> 3 . The Village of Waunakee originally objected to the application <br /> for a variety of reasons. We have negotiated an agreement <br /> with the Village, pursuant to which we have agreed to do <br /> certain things, and the Village has withdrawn its objection <br /> and nows supports issuance of the permit. <br /> 4. Gempler' s objection: In Jan. 1993, Caldwell and Raemisch <br /> entered into an agreement that provided for extension of the <br /> permit onto the Ripp property and also called for the work we <br /> are now proposing to do on the Endres property. In return for <br /> this, Raemsich agreed that so many month he would terminate <br /> his quarry operations at the existing quarry. Now, we never <br /> got the right to expand onto the Ripp property and therefore <br /> the whole agreement became moot. We never used the permit to <br /> to do the work on the Endres property. Instead, we have come <br /> back to get a new permit. Mr. Raemisch was willing to sign <br /> the agreement with Caldwell because he was getting something <br /> for his• agreement: the right to expand upon the Ripp proper- <br /> ty. We never got that right and so that agreement is moot. <br /> There is no reason to include the sunset clause in this new <br /> permit. <br />
