The Conditional Use Permit (1026) that was issued in 1993 has <br /> not been enforced or upheld by the landowner, operators, or <br /> the Town of Westport (e .g. , construction fencing has not been <br /> constructed and maintained. <br /> 2 . The expansion and associated excavation requested in this CUP <br /> was to be completed by August 1, 1993 according to the <br /> agreement signed by the operators and owners on January 26, <br /> 1993 . This CUP is in violation of the provisions of the 1993 <br /> CUP and agreement . <br /> 3 . By signing that agreement the owners and developers have <br /> acknowledged that there are substantial zoning problems <br /> related to the proposed land and agreed to conditions <br /> designed to protect the health, safety, welfare, adjacent <br /> land uses and values and the future development of the area. <br /> The proposed expansion is inconsistent with those public <br /> interests and wholly incompatible with residential land uses . <br /> 4 . The Waunakee Heights Subdivision located in the Village of <br /> Waunakee is immediately adjacent to the quarry. <br /> Thank you for your time and consideration of this matter. <br /> S ' erely, <br /> Paul E.
