Mr. Niesen now owns the <br /> 3 .3 acre parcel of vacant land located west 8200 Stage Coach Road, Cross <br /> Plains, Wisconsin, and legally described as Lot One (1) , Certified <br /> Survey Map No. 3898, Town of Cross Plains, Dane County, Wisconsin. Mr. <br /> Niesen desires to file a rezone petition to rezone the easterly 245 . 64 <br /> feet of this parcel to LC-1 Commercial District from A-1 Agricultural <br /> District (exclusive) and the westerly 324 feet of this parcel to A-B <br /> Agricultural District from A-1 Agricultural District (exclusive) . Mr. <br /> Niesen requests that the Zoning Committee find there are requisite <br /> grounds for resubmittal of his petition under Section 10 .255 (1) (c) of <br /> the Dane County Ordinances. <br /> 1. Factual Background. <br /> The Zoning Committee conditionally approved Rezone Petition No. <br /> 5898 on June 28, 1994, by a vote of 5 to 2 . The Dane County Board of <br /> Supervisors adopted Rezone Petition No. 5898 on July 21, 1994, by a vote <br /> of 22 to 15, but County Executive Rick Phelps vetoed Rezone Petition No. <br /> 5898 on August 18, 1994 . The Dane County Board of Supervisors failed to <br /> override the County Executive' s veto. <br /> Mr. Niesen desires to resubmit his rezone petition this month <br /> without having to wait one full year (after August 18, 1995) to avoid <br /> hardships. Mr. Niesen owns and operates a thriving landscape business. <br /> Due to the seasonal nature of his business, Mr. Niesen is best able to <br /> devote sufficient time and energy to and muster support for his petition <br /> during his period of slowest business activity (the winter months) and <br />
