Can a town pursuant to <br /> 66. 038 actually prevent a mineral extraction if all aspects of <br /> their reclamation ordinance have been or will be adhered to? <br /> Example: Public Works has an application for a conditional use <br /> permit for clay extraction in the Town of Cottage Grove. The Town <br /> Board has recommended denial of the CUP. If the county approves <br /> the CUP can the town still prevent the extraction. A copy of <br /> Cottage Grove's Reclamation Ordinance is attached for your <br /> information. <br /> The zoning committee will be considering action on this May 24, <br /> 1994, we would appreciate your response by that time.
