Hy Cite hereby grants Swenson an easement and right-of-way over and across the <br /> following parcel of real estate (hereinafter referred to as "Easement Area"): <br /> The West 198 feet of the following described property: <br /> Part of the Southeast Quarter of Section 36, Township 7 North, Range 9 East, <br /> Town of Madison,Dane County,Wisconsin,to wit: Beginning at the East quarter <br /> corner of said Section 36; thence South 00 degrees 09 minutes East, along the <br /> East line of Paid Section 36, 412.00 feet; thence South 89 degrees 31 minutes <br /> West,2074.52 feet thence North 00 degrees 50 minutes 40 seconds West,387.25 <br /> feet; thence South 89 degrees 30 minutes 50 seconds West, 570A1 feet to the <br /> centerline of Badger Road;thence North 00 degrees 50 minutes 10 seconds West, <br /> along said centerline 24.75 feet to the center of said Section 36; thence North 89 <br /> degrees 30 minutes 50 seconds East, 2650 feet to the point of beginning. <br /> Said easement shall run to Swenson and her invitees, licensees, guests and permitees, for <br /> purposes of ingress and egress, including vehicular traffic, from and between Badger Lane and <br /> Parcel B. <br /> 2. A gravel driveway presently runs through a portion of the Easement Area. Until such <br /> time and except for such periods as Hy Cite shall have assumed sole responsibility for <br /> maintenance of the Easement Area and the removal of snow therefrom as set forth at Section 3 <br /> herein, Swenson may grade, gravel and/or resurface,repair, replace and maintain such driveway <br /> and remove snow therefrom,provided all expense for such work performed by or at the direction <br /> of Swenson shall be paid by her. <br /> 3. This easement shall be nonexclusive, and Hy Cite reserves the right for itself and its <br /> employees,invitees,licensees,guests,permitees and assignees to use the Easement Area for any <br /> purpose or purposes which shall not impair Swenson's rights hereunder. Hy Cite shall have the <br /> express right to use the Easement Area as a driveway to its adjoining lands, and in furtherance <br /> of such use may improve the Easement Area by placing an asphalt or concrete surface thereon. <br /> In the event that Hy Cite shall make such improvement of the Easement Area as a driveway to <br /> its adjoining lands, and during the continuance of its use for such purposes, Hy Cite shall be <br /> solely responsible for the maintenance of the Easement Area as a driveway and the removal of <br /> snow therefrom. <br /> 4. Neither party shall make any use of the Easement Area which shall unreasonably <br /> interfere with the rights of the other party hereto_ Neither party shall park vehicles within the <br /> Easement Area,nor allow such vehicles to be parked by others in a manner so as to unreasonably <br /> interfere with the other party's use of the Easement area, nor otherwise obstruct the use of the <br /> Easement Area for driveway purposes. <br /> 2 <br />
