Teitgen, Chairman <br /> Town of Mazomanie <br /> Land Plan Committee <br /> May 24, 1994 <br /> Mr. Rick Schoenemann <br /> 6265 Woodland Drive <br /> Waunakee, WI 53597 <br /> Re: Rezone Application Number No. 5971 <br /> Dear Mr. Schoenemann: <br /> You appeared before the Land Plan Committee on May 16, 1994 and requested that the Committee <br /> consider your request to separate the existing residence from the farmland and change the zoning of the <br /> remainder of parcels 182 and 183 from Exclusive Ag to RH-3. The portion of parcel 182 containing the <br /> residence was changed to RH-1 zoning in 1992. See Exhibits A thru D. <br /> Upon questioning, you indicated a desire to have the possibility of creating three lots of RH-3 zoning <br /> classification for home-sites. <br /> A large group of neighbors opposed to the rezoning attended the meeting and presented a petition also <br /> in opposition. <br /> BACKGROUND <br /> Since March, 1979, the Town of Mazomanie Land Use Plan has restricted subdividing (parceling off) <br /> of agricultural land to not more than one division per 4-0 acres. <br /> In 1980, as shown on Exhibit D, the Schoenemanns owned approximately 53 acres, exclusive of <br /> Evergreen Acres. According to the Land Plan this property would have been entitled to one subdivision. <br /> Sometime in the 1980's, approximately 6.6 acres, identified as portion "C" in Exhibit G was parceled <br /> off and sold to Dan Behringer. <br /> In 1986, approximately 9.6 acres were parceled off per zoning request 3656. <br /> In 1992, the Committee and Town very reluctantly agreed to permit rezoning the a portion of the <br /> property containing the existing residence to RH-1. <br /> As shown on Exhibit F, the Committee was led to believe that the total acreage prior to rezoning was 39 <br /> acres, which would leave 37 acres after rezoning, thus preserving the exclusive ag status for the <br /> remaining property. In fact, this portion is closer to 34 acres, which is less than required for exclusive <br /> ag zoning. <br />
