TO:Mr. Lyman Anderson <br /> FR:Roger, LuAnn Guffey <br /> 3747 Mueller Road. <br /> RE:Rezoning of 3757 Mueller Road <br /> 7/7/94 <br /> Our concerns... <br /> 1. Joint Well. Our current well agreement holds us responsible for 50%of repair costs to the <br /> well. Animals require daily water. An establishment for boarding a large group of Animals would <br /> put a significant amount of stress and cause its rapid deterioration. It is our concern that we will be <br /> assessed for half the repairs for damage that occurred through no fault of our own. <br /> 2. Distance. The distance between our homes is approximately 100 feet.. The distance between <br /> our home and the proposed site of the kennel on 3757 does not.exceed 300 feet. The planned size 20 t) <br /> of the kennel makes it too big to be that close to our residence. <br /> 3. Noise. The kennel,if built,will hold over 40 dogs. Dogs have a tendency to bark often and at <br /> loud volumes. Multiply one dog by forty, and you have a serious case of noise pollution. On <br /> 6/26/94,John Schlitz admitted that a barking dog is"annoying". <br /> 4. Value. Approximately 18 months ago, we had our home refinanced. It was valued at 200,000 P2(1 01 <br /> (using rounded off figures). If we wished to sell our house,would anyone want to pay that kind <br /> of money and live within 300 feet of forty barking dogs? If the kennel is built, we will live next to <br /> it at a loss. <br /> 5. Conditional Use Permit. When the permit was voted on,why wasn't it stated that if the <br /> Schlitz's sell their property,the business does not go to the new owners. The new owners should <br /> have to reapply for the zoning. <br /> 6. Hours for Dogs Outside. According to the Use Permit the dogs are allowed outside between the <br /> hours of 7 am and 7 pm,for a total of twelve hours a day. Our family is home every day during 'f ,r) <br /> the summer months. Mom is home all day and the kids prefer to sleep late. Mom works for the <br /> school system, and this is her time to relax before returning for another school year. The problems VI-A'N <br /> involved in the education of children are almost as stressful as forty barking dogs. (Owl 'w. <br /> 7. Schlitz's Concern,or Lack Thereof. The Schlitz family has two labs and six puppies already. <br /> They also have an empty parcel of land on the side of their property away from our house. They <br /> could easily have located their dog's facilities on that parcel of land. Instead,they chose to put <br /> them next to the lot line 100 feet from our house,under bedroom windows. They have already <br /> disturbed us with their late night barking <br /> 8. Our Reasons for Living Here. We have lived here for four years. We came to the country for <br /> it's aspect of peace and calm. The Schlitz family has lived next to us for a mere 12 months. When <br /> we met with the Schlitz's last April,they were told up front about our concern for maint4i ni ng a <br /> quiet environment. They also knew that the land was zoned for farming, and that the shared pump <br /> was under a 50/50 agreement. If they desired a dog kennel,they should have found a more <br /> secluded house with more appropriate land. Instead,they move into the only house in the area <br /> which has another house right next to it. <br /> 9. Saving Agricultural Land. The Town Board has expressed an interest in the preservation of <br /> agriculturalland, and has passed a ruling known as the"35 Acres Rule". The Schlitz's land is <br /> already zoned agriculture. And yet,it is being considered for rezoning,which would remove the <br />
