DANE COUNTY <br /> CONDITIONAL USE PERMIT #1168 <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE OF THE DANE COUNTY BOARD <br /> PURSUANT TO SECTION 10.255 (2) OF THE DANE COUNTY CODE OF <br /> ORDINANCES DOES HEREBY: <br /> DENY the conditional use permit. <br /> FOR: Governmental Use - Elementary school <br /> EFFECTIVE DATE OF PERMIT: NA EXPIRATION DATE: NA <br /> THE CONDITIONAL USE PROPOSED TO BE LOCATED ON THE PROPERTY <br /> DESCRIBED AS FOLLOWS: <br /> Part of the SW 1/4 NE 1/4 of Section 27, Town of Springfield <br /> described as follows: Commencing at the East quarter corner of <br /> said Section 27; thence N 89° 41 ' 58 ' West 1331.79 feet to the <br /> point of beginning; thence N 00° 53 ' 33" East 1333 .21 feet; thence <br /> N 89° 43 ' 19" West 664.85 feet; thence S 00° 56 ' 15" West 1332 .96 <br /> feet; thence S 89° 41' 58" East 665.90 feet to the point of <br /> beginning. <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE AFTER PUBLIC HEARING AND <br /> IN THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE <br /> FOLLOWING FINDING OF FACT: <br /> 1. That the establishment, maintenance and operation of the <br /> proposed conditional use will be detrimental to or endanger the <br /> public health, safety, morals, comfort or general welfare. <br /> 2. That the uses, values and enjoyment of other property in the <br /> neighborhood for purposes already permitted will be <br /> substantially impaired or diminished by the establishment, <br /> maintenance and operation of the proposed conditional use. <br /> 3 . That the establishment of the proposed conditional use will not <br /> impede the normal and orderly development and improvement of the <br /> surrounding property for uses permitted in the district. <br /> 4. That adequate utilities, access roads, drainage and other <br /> necessary site improvements will be made. <br /> 5. That adequate measures will be taken to provide ingress and <br /> egress so designed as to minimize traffic congestion in the <br /> public streets. <br /> 6. That the proposed conditional use does conform to all applicable <br /> regulations of the district in which it is proposed to be <br /> located. <br /> 7. This use will not benefit the needs of either the residents or <br /> the agricultural activities in the area. <br /> 8. There are not other locations available for this use. <br /> 9. The land to be occupied by this use is productive agricultural <br /> land. <br /> 10 Public services needed by this use are not available. <br /> 11 Public services needed by this use can not be furnished without <br /> becoming an unreasonable burden on the taxpayers. <br /> 12 This use at this location will not cause significant harm to the <br /> environment. <br />
