The project
site is located in Sec. 13, T. 9N. , R. 9E. , Dane County, Wisconsin.
This work is eligible for authorization by a Department of the Army
nationwide permit, provided the enclosed conditions are followed. However,
because the Corps considers Clean Water Act Section 401 Water Quality Cer-
tification for this nationwide permit to have been denied by the Wisconsin
Department of Natural Resources (WDNR) , you must obtain a Section 401
Certification from WDNR in order for the nationwide permit to be valid for
your project.
Contact the local WDNR Area or District office for the Section 401 Certi-
fication. You may consider your project authorized by the nationwide permit
when you receive that determination or the WDNR permit for which you applied.
It is your responsibility to ensure that the work complies with the terms
of this letter and the enclosures. IT IS YOUR RESPONSIBILITY TO OBTAIN ALL
REQUIRED STATE AND LOCAL PERMITS AND APPROVALS BEFORE YOU PROCEED WITH THE
PROJECT.
If you have any questions, contact Jan Schwalbe in our St. Paul office at
(612) 220-0366.
Sincerely,
Enclosure(s) Wopat
Chief, Regulatory Branch
Construction-Operations Division
Determination: 33 CFR 330-App. A, Nationwide permit number (26)
Appendix iv
