4 <br /> PETITION NO. (rr Q L, Le <br /> STATEMENT ACCOMPANYING ZONING PETITION <br /> Thomas W. Shellander <br /> Mary B. Ruedinger <br /> 5486 Schuman Road <br /> Cross Plains, WI 53528 <br /> Daytime Phone: 608-837-7386 <br /> We are requesting the rezoning from A-1 exclusive to RH-2 of <br /> real estate we own in Sections 22 and 23 in the Town of Berry, Dane <br /> County, Wisconsin, more particularly described as Lot Three (3) <br /> Certified Survey Map 2663. We are requesting the change for <br /> purposes of dividing the lot into two lots so as to permit the sale <br /> of currently unused land. The lot consists of 10.81 acres; a <br /> photocopy of the Certified Survey Map containing Lot Three is <br /> attached hereto as Exhibit A. The Certified Survey creating the <br /> lot was recorded in the Dane County Register of Deeds office on <br /> November 29, 1977. <br /> Exhibit B which is attached hereto was prepared by our <br /> surveyor, R. R. Sarko & Associates, Inc. , and shows the approximate <br /> division which we desire for the lot. The southern lot will <br /> contain between four and five and one-quarter acres. We desire to <br /> sell the southern lot to a prospective purchaser for the purpose of <br /> the purchaser's building a single family residence on the property. <br /> Our residence is located on the northern lot and we intend to <br /> continue living there. The southern lot is currently not used for <br /> agricultural purposes and is mainly woodlands. A ridge naturally <br /> divides the northern lot and the southern lot just to the north of <br /> the northern boundary of the southern lot, as drawn on Exhibit B, <br /> which makes the proposed division consistent with the topography. <br /> We believe that the division and creation of a single family <br /> residence is consistent with the sections in which our land is <br /> located which contain approximately ten similar single family <br /> residences. <br /> The Town of Berry Planning Commission has come to our land and <br /> has physically viewed the proposed division and has provided <br /> preliminary approval. The full Town of Berry Board has also <br /> reviewed the requested division and has agreed that our dividing <br /> off one lot is consistent with the Town plan. <br /> Preliminary perc tests were performed by Meinholz Excavating <br /> of Waunakee, Wisconsin. Meinholz Excavating has given permission <br /> to state that, in its (oral) opinion, the land will perc, although <br /> a full blown perc test has not been performed at this time. <br /> We understand that a Certified Survey Map must be recorded in <br /> order to accomplish our land division. The exact dimensions of the <br /> southern lot will be determined after negotiations with perspective <br /> buyers of the real estate. After such negotiations have been <br /> completed, a Certified Survey Map with the exact dimensions of the <br /> lot will be prepared and submitted to the Town and County for <br />
