September 13, 1994 <br /> Dane County Zoning and Natural Resources Committee <br /> re: Conditional use permit for 21 Nygard Street, Madison Pentecostal Assembly <br /> Dear Committee Members, <br /> On October 22, 1985 the Agriculture, Environment and Zoning Committee of the Dane <br /> County board granted conditional use permit#462 to the Madison Pentecostal Assembly. The <br /> permit was granted despite neighborhood concerns about runoff,noise, safety, parking, and <br /> decreased property values, and a recommendation by the Town of Madison that the permit be <br /> denied. Nine years later we find ourselves in the same situation. This time I hope the board will <br /> listen to the real experts in this case--the residents of Nygard Street <br /> Because members of the board do not live on Nygard Street, as I do, I would like to fill you in <br /> on what has happened since the church was constructed. One of the concerns expressed 9 years <br /> ago was runoff. The church is located on a steeply sloping lot that faces Nygard Street. Nygard <br /> Street does not have curb or storm sewers. We were told that construction of the church, a 29 <br /> car parking lot, and a 22 feet wide driveway 280 feet long would not result in any increased <br /> runoff. In order to accomplish this the church was required to implement a drainage plan <br /> designed to retain runoff on church property. I live across the street from the church at the low <br /> point of the street. I doubt that anyone is better aquatinted with runoff patterns on Nygard Street <br /> than I am, and I can tell you the system is a complete failure. The drainage system was built such <br /> that it requires water to run uphill. As a consequence, each time it rains water from the 29 car <br /> parking lot and driveway runs directly onto Nygard Street and enters into my yard. It then flows <br /> the length of my yard, front to back, after which it enters the yard of 203 Sunnymeade La. As a <br /> consequence of the increased runoff since the church was constructed portions of my yard have <br /> literally been eroded away and I have had water enter my basement. The owner of the apartment <br /> at 203 Sunnymeade La., Chuck Webster,has threatened legal action against me because of the <br /> runoff Both Mr. Webster and I have had to spend time and money repairing damages and trying <br /> to prevent further damage. <br /> Repeated requests to Mr. Johnson, Max Uttech, now retired town of Madison building <br /> inspector, and Joe Daniels Construction Company have not resulted in any improvements to the <br /> runoff problems. This is a clear violation of the terms of the conditional use permit. During a <br /> town of Madison board meeting three weeks ago I once again informed Mr. Johnson of the <br /> problem. His response was that the church had a system in place as required, if it didn't work that <br />
