It was also during that meeting that I <br /> learned that the Zoning Division of the Department of Land Regulation and Records has <br /> jurisdiction in this matter. I have since written a letter to the board asking that Madison <br /> Pentecostal Assembly be required to live up to the spirit and letter of the terms of the conditional <br /> use permit by retaining their runoff on site. Mat Wenzel,the current town of Madison building <br /> has inspected the drainage system and in his opinion it does not function,nor has it likely ever <br /> worked properly. Mat has sent the zoning board a letter stating his opinion, as I've outline it. <br /> Now the church wants to expand onto an adjacent property with a large backyard,nearly a <br /> 1/2 acre. Will this become another 1/2 acre of blacktop draining through my yard? <br /> Noise was another concern expressed 9 years ago. Again, we were told not to worry,there <br /> would not be any increased noise. How can you have 30 to 40 cars and 50 to 100 people entering <br /> and exiting a single building and driveway at the same time without producing any noise? I have <br /> personally called the church twice to ask to have it quieted down. Both times it was after 10:30 <br /> p.m. My requests were promptly complied with,but should I need to make such a request in the <br /> first place? I've never had to ask any of my other neighbors to please keep it down. For the two <br /> times I did call, there were another dozen times when I wanted to call but didn't. <br /> Noise is one of the biggest reasons that Warren Dettinger is selling his house-he just can't take <br /> it anymore and wants to escape. I think if you look at police records you'll see that Warren has <br /> called the police more than once because of the noise. <br /> If the church expands the noise will get worse not better. It will be spread out over 2 yards <br /> not just one. Traffic will be going up and down two driveways and people will be moving from <br /> building to building. The large back yard offers the possibility of outdoor services. <br /> On street parking by church members is in an ongoing problem. When the conditional use <br /> permit was originally granted on street parking was prohibited to prevent such problems. This <br /> was okay with the church because they said they didn't plan on parking on the street anyway-their <br /> lot was big enough. The prohibition against on street parking was stricken from the conditional <br /> use permit because it was considered unenforceable. Obviously,the parking lot is no longer large <br /> enough. Currently, as many as 10 cars park on the street each Sunday and at other times during <br /> the week. Residents near the church have been blocked out of their driveways and Nygard Street <br /> is reduced to one lane that shifts from one side of the street to the other. Following a recent <br /> house fire on Nygard Street,the firemen commented that if the fire had occurred when the church <br /> was in service they would not have been able to get rescue vehicles to the house. The number of <br /> vehicles driving up and down Nygard Street to attend services probably exceeds the number of <br />
