Page 2 <br /> Bowman Appeal <br /> Mr. Robert applied for a zone change, petition# 6090, from the A-1 Ex district to <br /> the RH-2 and RH-4 zoning districts in November of 1994. Approval of the rezoning <br /> request required both Town and County approval; Town approval was obtained but <br /> County approval was not, the property remains as A-1 Ex. The Dane County Regional <br /> Planning Commission Staff report on this rezoning petition indicated that it would conflict <br /> with density policy in the Town of Cross Plains: "Lands in the agricultural district should <br /> not be rezoned for non-farm residential development at an overall density of greater than <br /> one dwelling per 35 acres owned as of the date of adoption of this plan." This <br /> inconsistency with the adopted plan was cited by some officials as their principle reason <br /> for rejecting the rezoning, other reasons were also cited. <br /> Factual Background <br /> Section 10.28 of the Dane County Ordinance stipulates" that all ordinances or parts of <br /> ordinances in conflict with the provisions of this ordinance are hereby repealed." <br /> Section 10.123(9)(b) of the Dane County Zoning Ordinance states that " substandard <br /> parcels in the A-1 Exclusive Agricultural District which do no comply with the minimum <br /> parcel size standards of section 10.12(6)(a) shall comply with the standards of section <br /> 10.05(4)." Section 10.12(6)(a) requires that the minimum area for agricultural uses shall <br /> not be less than 5 acres; whereas Section 10.05(4) requires a minimum of 20,000 square <br /> feet for residential uses. Section 10.123((9)(b) also requires that residential buildings on <br /> substandard parcels in the A-1 Ex district shall also comply with locational requirements <br /> of the R-1 district. <br />
