July 13 , 1993 <br /> Dane County Zoning Commission <br /> C: Bill Flick <br /> Dane County Zoning Clerk <br /> Ladies and Gentlemen, <br /> Because of recent activities related to the expansion of <br /> activities around the Yahara Materials Quarry located on highway 12 <br /> in the town of Springfield, my wife and I have realized that you <br /> have not been informed properly of some of the activity relating to <br /> the quarry. <br /> I spoke at the zoning commission meeting objecting to the granting <br /> of a CUP for the temporary asphalt plant to be located within the <br /> Yahara quarry. I alluded to the incidents that I will document <br /> with this correspondence . It will only be credible if we provide <br /> the detail that is attached. <br /> We have had significant damage done to our home as a result of the <br /> activities associated with the blasting at the quarry. The major <br /> damage resulted in us involving DIHLR' s Safety and Buildings <br /> Division to investigate activities at the quarry and pressure more <br /> responsible practices . <br /> Attached is the incident report filed with the Dane County Sheriff . <br /> Next you will find our letter to Yahara Materials informing them of <br /> the incident . No action was taken. More importantly you will find <br /> a report from Mr . Gates of DIHLR detailing his original <br /> investigation and recommendations . Please note that Mr. Burcalow <br /> (Yahara 's owner) and Mr . Ahlgrimm (the blasting contractor) we both <br /> present in our home during the investigation. Mr. Burcalow agreed <br /> to notify their insurance carrier. Through protracted cooperation <br /> and patient waiting we were eventually informed that we would have <br /> to start over with Alhgrimm' s insurance carrier because they were <br /> responsible. Eventually Alhgrimm' s carrier hired "experts" who <br /> came in and wrote a report that denied the claim with "facts" that <br /> were in direct conflict with the documented state reports of the <br /> facts and the damage . Eventually we pursed our own insurance, <br /> whose "expert" Dr . Fausett , found the damages were caused by the <br /> blast and honored the claim <br /> When they were unable to subrogate the damage against Alhgrimm' s <br /> carrier, they notified us that the $4687 . 33 claim was the reason <br />
