July 13 , 1993
Dane County Zoning Commission
C: Bill Flick
Dane County Zoning Clerk
Ladies and Gentlemen,
Because of recent activities related to the expansion of
activities around the Yahara Materials Quarry located on highway 12
in the town of Springfield, my wife and I have realized that you
have not been informed properly of some of the activity relating to
the quarry.
I spoke at the zoning commission meeting objecting to the granting
of a CUP for the temporary asphalt plant to be located within the
Yahara quarry. I alluded to the incidents that I will document
with this correspondence . The major
damage resulted in us involving DIHLR' s Safety and Buildings
Division to investigate activities at the quarry and pressure more
responsible practices .
Attached is the incident report filed with the Dane County Sheriff .
Next you will find our letter to Yahara Materials informing them of
the incident . No action was taken. More importantly you will find
a report from Mr . Gates of DIHLR detailing his original
investigation and recommendations . Please note that Mr. Burcalow
(Yahara 's owner) and Mr . Ahlgrimm (the blasting contractor) we both
present in our home during the investigation. Mr. Burcalow agreed
to notify their insurance carrier. Through protracted cooperation
and patient waiting we were eventually informed that we would have
to start over with Alhgrimm' s insurance carrier because they were
responsible. Eventually Alhgrimm' s carrier hired "experts" who
came in and wrote a report that denied the claim with "facts" that
were in direct conflict with the documented state reports of the
facts and the damage . Eventually we pursed our own insurance,
whose "expert" Dr . Fausett , found the damages were caused by the
blast and honored the claim
When they were unable to subrogate the damage against Alhgrimm' s
carrier, they notified us that the $4687 . 33 claim was the reason
