5 . Reclamat.ion Plan. The quarry shall be reclaimed to <br /> farming and agricultural uses, except for the Pond, to the extent <br /> reasonably practicable. The quarry will be developed in sequenced <br /> phases . Each area from which all useable material has been <br /> extracted shall be reclaimed as soon as reasonably practicable as <br /> each new area is developed. Reclaimed areas shall be covered with <br /> overburden and topsoil and shall be seeded as soon as reasonably <br /> practicable after placement of the topsoil, except for the Pond. <br /> The Pond shall be spring-fed and shall be designed and constructed <br /> in accordance with local, State and federal regulations . Each area <br /> shall be reclaimed with a final slope not steeper than a 3-1 <br /> horizontal slope including the portion of the Property adjacent to <br /> the Pond. The quarry shall not have more than five (5) acres of <br /> area opened for mineral extraction operations at any time. Topsoil <br /> and overburden on the Property shall remain on-site and shall be <br /> stockpiled as berms on the Property. The berms shall be located so <br /> as to screen the operation from view to the extent reasonably <br /> practicable. No foreign material shall be buried on the Property. <br /> Final reclamation of the last opened area shall be finished within <br /> two (2) years after all mineral extraction operations have ceased. <br /> Operator shall post and maintain at all times during the term of <br /> this Restated Agreement and the Amended CUP, and for a period of <br /> two (2) years after all mineral extraction operations have ceased <br /> or upon completion of reclamation if within such two (2) year <br /> period, whichever is later, an irrevocable letter of credit in a <br /> form acceptable to the Town Board in the amount of Fifty Thousand <br /> Dollars ($50, 000 . 00) payable to the Town of Vienna, to insure <br /> compliance with the reclamation plan. <br /> 6 . Permits and Environmental Compliance. Operator shall <br /> secure and maintain in full force and effect prior to commencement <br /> of quarry operations all permits from federal, State and local <br /> authorities necessary to open and operate the quarry. <br /> 7 . Insurance. Operator will secure and maintain in full <br /> force and effect during the term of this Agreement, public <br /> liability insurance in the amount of Two Million Dollars <br /> ($2, 000, 000 . 00) naming the Town as an additional insured as its <br /> interests may appear. <br /> 8 . Fencing. Operator shall not be required to maintain a <br /> fence around the mineral extraction operation at this time. In the <br /> event conditions change in the area of the Property during the term <br /> of this Restated Agreement, the Quarry Advisory Committee, if <br /> created as provided in section 9, following, may recommend that a <br /> fence and gate be iris; ull�;;, and L:.L. 3perator shall then install a <br /> suitable fence and gate at its expense. <br /> 9 . Quarry Advisory Committee. Operator shall participate in <br /> the affairs of the Quarry Advisory Committee which may be <br /> -5- <br />
