y ` a <br /> the University of Wisconsin-Madison Department of <br /> Geological Sciences or other qualified neutral <br /> consultant . <br /> (v) The non-prevailing party to the dispute shall <br /> have the responsibility for payment of all reasonable <br /> costs and reasonable attorney's fees of the prevailing <br /> party and the costs of the University of Wisconsin- <br /> Madison Department of Geological Sciences or other <br /> qualified neutral consultant incurred in rendering its <br /> decision. <br /> (vi) Operator shall post and maintain at all times <br /> during the term of this Agreement and the CUP, an <br /> irrevocable letter of credit in a form acceptable to the <br /> Town Board in the amount of Ten Thousand Dollars <br /> ($10, 000 . 00) as security for its obligations under this <br /> subsection. <br /> D. Noise. At all times during the term of this <br /> Agreement, Operator shall require all trucks entering and <br /> leaving the quarry to have proper muffler systems and controls <br /> which meet or exceed the then most current industry standards <br /> for noise abatement . <br /> E. Transportation. The only entrance to the quarry <br /> area shall be the existing driveway entering on Highway DM. <br /> Additional access points may be allowed by the Operator for <br /> agricultural uses on the Property. Access roads and haul roads <br /> will be maintained in a dust-free manner in accordance with <br /> local, state, and federal regulations . <br /> F. Hours of Operation. Hours of operation shall be <br /> from 6 : 00 a.m. to 6 :00 p.m. , not including maintenance time, <br /> Monday through Saturday. No operations shall be conducted on <br /> Sundays or legal holidays without Operator first having <br /> received approval from the Town Board. These hours may be <br /> expanded with the approval of the Town Board if the quarry <br /> operations are being performed for public contracts . <br /> G. Stormwater and Drainage Control . Stormwater in the <br /> opened area of the quarry shall be controlled by use of one or <br /> more of the following methods : grading, contouring, berming, <br /> landscaping and use of the Pond. Stormwater within the quarry <br /> area shall be directed to the Pond, and stormwater from land <br /> adjacent to the Property shall be controlled so as not to run <br /> into the Pond. <br /> H. Dust Control . Operator will maximize dust control <br /> in accordance with local, State and federal regulations . <br /> -4- <br />
