COMPOSIT REPORT <br /> APPLICATION #% ?8 — L u P 8•61"5 <br /> TOWN BOARD COMMENT: <br /> STAFF COMMENTS <br /> REGIONAL PLANNING COMMISSION (RPC) <br /> Petition 5698, CUP 1085. This proposed rezoning for a trucking business in the Town of Westport is <br /> similar, but a slightly smaller area than Petition 5555 of February 1993. That petition was denied by the <br /> town and subsequently withdrawn by the applicant. <br /> Generally, this is an agricultural preservation area of the Town of Westport. <br /> The entire area shown on the map is zoned A-1 Exclusive, except for the A-2 area to the southeast (a <br /> mineral extraction site). <br /> The relevant policy for this area is: <br /> "Agricultural businesses and home occupations compatible with agriculture may be permitted <br /> to rezone in the Agricultural Preservation District if the following criteria are met: <br /> a. A rural location is required to serve farmers; <br /> b. Close proximity to a rural resource is required: <br /> c. Discourage use of prime agricultural land as defined by the USDA Soil Productivity <br /> Classification map in Chapter II titled Background Report; <br /> d. The site is suitable for an on-site wastewater treatment absorption system; <br /> e. If commercial rezoning is requested, such use will include appropriate conditions to <br /> prevent other unacceptable commercial uses of the site in the future. <br /> ENVIRONMENTAL HEALTH DEPT.
