ORDINANCE AMENDMENT NO. 5704 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> WESTPORT <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Westport be amended to include in the R-1 <br /> and R-4 Residential District the following described land: <br /> Pet. #5704: <br /> Part of the NW 1/4 NE 1/4 Section 23, Town of Westport described as follows: <br /> Beginning at the Northwest corner of said Lot #1 , thence S 38° 37 ' 55" West , <br /> along the Easterly line of said Lot #1 , 322.01 feet to the Southeast corner of <br /> said Lot #1 ; thence N 50° 09' 01 " West, along the Southerly line of acid Lot <br /> #1 , 357.21 feet; thence N 38° 37 ' 57" East, 98.58 feet; thence along the arc of <br /> a curve to the left whose radius is 60.00 feet and whose chord bears N 38° 37 ' <br /> 55" East, 120.00 feet; thence N 38° 37 ' 57" East, 95.84 feet to the Northerly <br /> line of said Lot #1 , thence S 51° 22' 05" East, along said Northerly line, <br /> 357.13 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> - Conditional zoning is hereby imposed pursuant to Section 10.255- (3)(a ) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. The R-4 zoned lands (Proposed Lot #1 ) are restricted to a maximum number <br /> of (4) four units. <br /> B. A Driveway Permit from the Town of Westport to obtain access to River <br /> Road for Proposed Lot #2. <br /> C A sewer easement and right to connect to the private interceptor system <br /> through proposed Lot #1 with cost to be paid by Proposed Lot #2. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of property within 300 feet of the site. Failure <br /> to record the restrictions will cause the rezone to be null and void. <br /> EFFECTIVE DATE: <br />
