• <br /> • <br /> DECLARATION OF COVENANTS AND RESTRICTIONS <br /> WHEREAS, 1'?Ac, 'd GLd_opy,nic c ,,, , are the owners of the following described lands in <br /> the Town of Windsor, Dane County, Wisconsin: <br /> 6 S y cAl in/a04(frt) (legal description) (,v JAL- ,s• <br /> WHEREAS, the above described property is located within a residential area known as the <br /> unincorporated Village of Windsor which is identified by the Windsor Comprehensive Plan as an <br /> area needing special considerations for development in order to preserve its neighborhood <br /> residential character while encouraging redevelopment and business investment; and <br /> WHEREAS, Owners have petitioned to rezone the above described property from A-1 zoning to <br /> C-1 zoning under the Dane County zoning ordinance; and <br /> WHEREAS, the Town of Windsor and the County of Dane have approved said petition conditioned <br /> upon certain covenants and restrictions being placed upon the above-described <br /> property; and <br /> WHEREAS, Owners desire to assure that use of the above described property is compatible with <br /> the goals and objectives of the Town of Windsor and the residential character of the surrounding <br /> neighborhood; and <br /> • <br /> WHEREAS, to accomplish these goals, Owners wish to place certain restrictions thereon, to bind <br /> the owner and those who may acquire title hereafter; <br /> NOW, THEREFORE, in consideration of the mutual benefits passing to and from the Owners and <br /> those who may hereafter purchase said land and the parties named as beneficiaries of these <br /> restrictions, the owners hereby declare that the above described property shall be used, held, sold <br /> and conveyed subject to the covenants and restrictions set forth below, which shall inure to the <br /> benefit of and encumber the above described property, and run with said land: <br /> 1. Permitted uses/prohibited Uses: Since the above described property is located within <br /> a residential neighborhood, it shall be limited only to the following uses: <br /> (a) Operation of a catering business to be owned and operated by the occupants <br /> of ( 7 (y Windsor Street, the adjacent residence, and which shall be limited to the <br /> occupancy of a single building not exceeding 600 square feet in area and developed in substantial <br /> conformity, including pavement and landscaping, with the site development plan attached hereto. <br /> (b) The Owner shall comply with building location, size, and screening <br /> restrictions and shall provide offstreet parking spaces as required by the Dane County Zoning <br /> Ordinance restrictions for a C-1 Zoning District in effect on the date of recording these restrictions. <br />
