COUNTY OF DANE <br /> CORRESPONDENCE MEMORANDUM <br /> DATE: August 25, 1993 <br /> TO: Middleton Town Board <br /> FROM: Bill Fleck, <br /> Zoning Administrator <br /> SUBJECT: Conditional Use Permit #1092, Russo <br /> Lyman Anderson has asked me to inform you of the committee action <br /> and the rationale for their decision. <br /> The Zoning and Natural Resources Committee by a 6-1 vote granted <br /> the CUP for a residence for a caretaker/watchman pursuant to <br /> Section 10. 14 (2) (i) of the Dane County Zoning Ordinance based on <br /> the fact that this use is provided for in the ordinance and that <br /> the committee under the authority provided by Section 10.255 (b) <br /> found that all of the standards specified by Section 10.255 (2) (h) <br /> were met. The committee's jurisdiction is specified by the <br /> ordinance and other issues may not be a consideration. The action <br /> of the committee pertained only to use and did not denote approval <br /> or disapproval of the type of residential structure which may be <br /> utilized for the caretaker. <br /> The Dane County zoning ordinance does not differentiate between <br /> types of structure but recognizes a structure based on its usage <br /> e.g. , mobile homes, double-wide or pre-built construction, stick- <br /> built structures are all considered legitimate structures for <br /> residential use. Zoning permits have been issued on a consistent <br /> basis for all of these types of construction since 1970 or before <br /> and we would be obligated to issue a permit for the mobile home in <br /> question if it was applied for. The issue of compliance with the <br /> Town Ordinance must be determined by you, the Town Board. <br /> The other issues mentioned by Mr. LaFond which fall under the <br /> jurisdiction of the zoning ordinance were 1. junk and unlicensed <br /> vehicles, 2 . dog kennel and, 3 . landscaping business. <br /> 1. Compliance is in process, owners of pertinent vehicles <br /> have been notified to either license or remove the <br /> vehicles from the property. As some of the owners are <br /> out of state or even out of the country we have allowed <br /> a one-year period for compliance. I expect that vehicle <br /> owners who live in the area to comply upon notice. <br /> 2 . A kennel is defined under section 10. 01 (30) Dane County <br /> Zoning Ordinance as being "any premise or portion <br /> thereof, where dogs, cats or other household pets are <br /> maintained, boarded, bred or cared for, in return for <br /> renumeration, or are kept for the purpose of sale" .
