A petition for an amendment to the Dane County Zoning Ordinance Was predented by <br /> j1,,f/ <br /> Plaintiff to t e 'lane County Agricultural, Environmental and Land Records Committee, the <br /> standing committee of the Defendant Dane County Board of Supervisors on September 1, 1993 and <br /> fter a public hearing on October 12, 1993 was approved by that committee by a 5-2 vote on <br /> November 9, 1993. <br /> 9. The Petition, #5760, is attached hereto as Exhibit 1 and incorporated herein by <br /> reference. The petition sought was to rezone from A-1 to C-2 to allow for use of the parcel as a <br /> P g P <br /> new auto and truck dealership. <br /> 10. The AELR Committees approval required a deed restriction be recorded containing <br /> the provision limiting the use to the sale and repair of nevi-and used vehicles. <br /> 11. The Defendant Dane County Board of Supervisors rereferred the petition to the <br /> 0 AELR Committee on November 18, 1993 and on November 23, 1993 the committee reapproved <br /> the zoning petition by a 6-1 vote. <br /> 12. Said petition was approved by the Dane County Board of Supervisors by a 21-16 <br /> vote on December 2, 1993. <br /> 13. Said petition had previously been approved by the Town of Springdale Planning <br /> Commission and the Springdale Town Board. It was also approved by the Village of Mount <br /> Horeb's Planning Commission on a 4-2 vote, but was rejected by the Village Board by a 4-3 vote, <br /> as being contrary to it's comprehensive plan for its extraterritorial area; this action was also <br /> arbitrary since the property in question was not within the area covered by the applicable village <br /> comprehensive plan thus depriving the village of jurisdiction to even consider the county zoning <br /> petition. <br /> 3 <br />
