• <br /> owner and trio owners of such adjoining farmland and expenses <br /> shall be subject to Wisconsin fence Taws 26229P 9 <br /> 19. These Covenants and Restrictions shall run with the land and <br /> shall be binding upon all owners and residents of the Lots <br /> covered by this document for a period of 30 years from the <br /> date this document Is recorded, after which time such <br /> Covenants and Restrictions shall automatically be renewed for <br /> successive 10 year periods unless an Instrument terminating <br /> or changing such Covenants and Restrictions In whole or In <br /> part Is signed by at least 66 % of the Lot owners. <br /> These Covenants and Restrictions may be amended at any time <br /> by an Instrument signed by not less that 88 % of the Lot <br /> owners. There shall be one vote for each Lot . While SBP <br /> owns any Lots In Grandview Heights, there shall be no <br /> amendments without SBP's prior written consent. <br /> 20. Any notice required to be sent to any Lot owner under the <br /> provisions of these covenants 'shall be deemed to have been <br /> properly sent when mailed postpa'd to the last known address <br /> of the person who appears as owner on the public tax records <br /> at the time of such mailing. <br /> 21 . If any person, or their heirs, successors or assigns shall <br /> violate or attempt to violate any of these Covenant ' and <br /> Restrictions, any person or person owning any Lot shall have <br /> standing to bring legal proceedings to enjoin the violation <br /> or for damages, or both. The prevailing party shall be <br /> awarded reasonable attorneys' fees and costs. Violation of <br /> any of these Restrictions shall not cause forfeiture of <br /> title. <br /> 22 . Invalidation of any one of these Covenants and Restrictions <br /> or any severable part of any Covenant and Restriction by <br /> Judgment or court order , shall In no way affect any of the <br /> other Covenants and Restrictions, which shall remain In full <br /> force and effect . <br /> 23 . All Lots are further subject to the applicable zoning laws, <br /> ordinances and building codes. <br /> 24 . Buyers are aware that Lot "E" has an existing home <br /> constructed as of the date these Covenants and Restrictions <br /> are recorded. Therefore, the present home Itself does not <br /> have to comply with these Covenants and Restrictions. <br /> However , any changes or additions to the present home or Lot <br /> must be In compliance with these Covenants and Restrictions. <br /> 25. An outbuilding built on Lot "E" must be built on the western <br /> half of the Lot . <br /> 26 . Unless sooner relinquished In writing by SBP, SBP shall have <br /> all the rights granted SBP under these covenants until the <br /> 90th day following the closing of the sale by SBP of the last <br /> Lot which It owns In Grandview Heights. On or before the <br /> 90th day SBP wilt mall out notices to each Lot owner <br /> notifying them of a meeting to be held at the Town Hall or <br /> Page 9 of 10 pages <br />
