If I remember correctly, because the impervious surface ratio was only proposed to be 2.2%as a result of the <br /> driveway, a determination of navigability wasn't pursued, rather we just treated it as navigable and issued the permit <br /> after reviewing the wetland delineation which showed the driveway and future buildin: would be outside of the <br /> wetland. <br /> At the time the permit for the Driveway was being issued, Melissa wasn't ready with plans for the building—also the <br /> building location was entirely beyond 300 feet from the stream. If I remember correctly, Melissa didn't have her <br /> checkbook with her so we issued the shoreland zoning permit for the driveway with the condition we would not issue <br /> the zoning permit for the barn until the $150 shoreland zoning permit fee was paid. <br /> Today Travis from Cleary stopped in to obtain the zojning permit for the barn. It appears that he has everything that he <br /> needs for the permit and the building will still be beyond 300 feet from the stream and outside of the wetland <br /> setback. We've taken in his permit and will process ft when we receive payment for the shoreland zoning permit issued <br /> in 2014. The initial filling of this property was done <br /> by a previous owner back in the late 1990's without our permit (see attached driveway permit).A stop work order was <br /> issued by Dane County Zoning and I believe DNR was involved back then too. Russ Bartlett with Dane County Zoning may <br /> have more information on the initial filling. The driveway was never surfaced or maintained and the fill reverted back to <br /> vegetation. <br /> The current owner, Melissa Huston, subsequently bought the property with the intention of constructing a driveway and <br /> horse barn. In the fall of 2014 work began on surfacing the driveway without a permit and I issued a stop work order. <br /> They produced the attached wetland delineation done by Stantec and applied for a shoreland erosion control permit. <br /> Drainage from east to west was initially a concern of ours as well, but it appears from the photos and site conditions, the <br /> filling in the 90's blocked surface drainage from the east. I believe the drainage now runs north at the berm toward CTH <br /> TT(photo 3 of delineation report). <br />
