DANE COUNTY ZONING PETITION # 5'81. <br /> Fuchs Trucking Company <br /> NW 1/4, SW 1/4, Sec. 18, T9N, R7E <br /> Town of Roxbury/Mazomanie, Dane County, Wisconsin <br /> EXECUTIVE SUMMARY <br /> History: <br /> *Fuchs Trucking Company has been located and expanding on this site for the past <br /> 35 years. <br /> *In 1972, Mr. Fuchs purchased a 20 acre parcel across Hwy. 78 to the east of the <br /> present facility. A zoning change to allow parking was rejected by the Roxbury Town <br /> Board and the Dane County Zoning Board, following a public hearing. Objections <br /> from the residents of the adjoining subdivisions and a highway safety concern by the <br /> Wis. DOT were reasons for the rejection. <br /> *1n the early 1970's, when the wetland overlay zoning was enacted, the Town Board <br /> could have exempt the trucking company property if they would have realized the <br /> negative impact it was going to have on operations and profitability in the future. <br /> *Fuchs Trucking company employs 150 people in northern Dane County and provides <br /> an extremely valuable livestock buying station and low cost transportation to distant <br /> markets for area farmers. <br /> "The lack of truck parking area has forced Fuchs Trucking to leave over 50% of their <br /> equipment in unprotected lots, which has created operating hardship, excessive <br /> maintenance cost and loss resulting from theft. <br /> *The original Army Corp of Engineers Fill Permit Application, (90-277-31VF90-600-31), <br /> by Fuchs Trucking Co., included 6.89 acres of fill. It was rejected pending County <br /> action on wetland rezoning. Rejection letter was dated August 5, 1991. <br /> *Correspondence with the Army Corp of Engineers indicated their willingness to <br /> entertain a second application, that would allow Fuchs Trucking Company to maintain <br /> a healthy business and improve the quality of the adjoining wetland. This was first <br /> presented to the Dane County Board in Zoning Petition #4928. The petition was to fill <br /> 4.2 acres of wetland and implement a restoration plan designed and supported by the <br /> late Prof. James Zimmerman, Consulting Ecologist. The petition was passed by the <br /> Dane County Board by a 30 to T vote. The plan was vetoed by the Dane County <br /> Executive, Richard Phelps, in May, 1992. <br /> in Mr. Phelps' veto message, he "proposed the resources of Dane County <br /> government be used to work with Fuchs Trucking Company to find alternatives to <br /> filling the wetland". <br /> RAMAKER & ASSOCIATES INC.
