RESTRICTIONS <br /> I. <br /> WHEREAS, is/are the <br /> owner/s of the following described land in the Town of <br /> Dane County, Wisconsin, to-wit: <br /> Part of the E 1/2 NE 1/4 and NE 1/4 SE 1/4 Section 28, Town of Albion <br /> described as follows: Commencing at the Northeast corner of said Section 28; <br /> thence along the North line of said Section 28, N 89° 56' 40" West, 216 feet <br /> to the point of beginning; thence South parallel to the East line of said <br /> Section 28, S 00° 19' 40" West, 363 feet; thence West parallel to the North <br /> line of said Sectin 28, N 89° 56' 40' West, 287.44 feet; thence South parallel <br /> to the East line of said Section 28, N 89° 56' 40" West, 287.44 feet; thence <br /> South parallel to the East line of said Section 28, S 00° 19' 40" West, <br /> 2278.85 feet to the South line to the NE 1/4 of said Section 28; thence along <br /> the South line of the NE 1/4 of said Section 28, N 89° 26' 40" East, 3.63 <br /> feet; thence S 00° 26' 00" West, 195.86 feet; thence N 88° 24' 50" West, <br /> 804.91 feet; thence N 00° 14' 44" East, 165.77 feet to the South line of the <br /> NE 1/4 of said Section 28; thence continuing N 00° 14' 44" East, 2017.39 <br /> parallel to the West line of the said NE 1/4 to the South line of Lot #4, <br /> Certified Survey Map #1011; thence S 89° 56' 40" East, 140.00 feet along the <br /> South line of said Lot #4; \thence N 00° 14' 44" East, 633.00 feet to the North <br /> line of said Section 28; thence East along the said North line of said Section <br /> 28, S 89° 56' 40" East, 952.94 feet to the point of beginning. <br /> II. <br /> WHEREAS, the said owner desires to place certain restrictions thereon, to bind <br /> the owner and those who may acquire title hereafter. <br /> III. <br /> NOW, THEREFORE, in consideration of the mutual benefits passing to and from <br /> the owner and those who may hereafter purchase said land and the parties named <br /> as beneficiaries of these restrictions, the following restrictions are hereby <br /> imposed: <br /> A. Use of the property shall be limited to an airport facility which is <br /> defined as a tract of land on which aircraft can land or take off on <br /> leveled grassed or hard-surfaced landing strips and including as may <br /> be necessary an office, pilot/passenger lounge or waiting area, <br /> hangers, control tower and accommodations for freight. <br /> B. Repair of aircraft by airport personnel is not permitted. <br /> These restrictions shall constitute covenants running with the land and <br /> shall be binding upon all parties now owning any part of said land, their <br /> successors, heirs and assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> IV. The restrictions provided for herein shall be enforceable at law or equity <br /> against any party who has or acquires an interest in the land subject to <br /> the restriction by the following parties who are named as grantees, <br /> promisees and beneficiaries with enforcement rights: <br /> (a) The County Government of Dane County, Wisconsin provided that the <br /> lands are under the jurisdiction of zoning ordinance of said County at <br /> the time the enforcement action is commenced; and <br /> 545 (12/92) 38 DR Doc <br />
