October 13, 1992 <br /> Page 3 <br /> Quarry operations necessarily involve blasting, noise, <br /> dust, heavy equipment traffic, and possible danger arising from <br /> deep, unfenced excavations, such as those at the present quarry <br /> site. None of these issues can be given adequate consideration on <br /> the basis of the present information in the application file. <br /> In addition, Section 10. 12 (3) 1 of the Ordinances <br /> specifically requires "a written description of the operation, a <br /> site plan and a reclamation plan" before Mineral Extraction can be <br /> approved as a conditional use in an A-1 Agricultural District. <br /> None of these materials has yet been filed, or available for public <br /> inspection and comment. <br /> This Ordinance also makes Mineral Extraction subject to <br /> the even more specific procedures and standards of Section 10.191 <br /> of the Ordinances which requires, in addition: <br /> 1. "a written description of the proposed operation, <br /> including a time schedule of development and termination, <br /> a site plan and a topographic reclamation plan;" <br /> 2. setback of all below grade excavations, equal to <br /> building setbacks; <br /> 3. retention of topsoil, for use in reclamation; and <br /> 4. specific standards for reclamation, restoration of <br /> grade, and use of topsoil. <br /> Again, none of these documents has been filed or available for <br /> inspection, analysis or comment by Town and Village residents and <br /> affected neighbors. <br /> Accordingly, we respectfully request that the public <br /> hearing on this matter be deferred until the applicant has met the <br /> requirements of the Ordinances by filing the necessary plans and <br /> documents, and thereafter until there has been a meaningful <br /> opportunity for the Committee, its staff, and members of the public <br /> to review them. That is clearly the intent and purpose of the <br /> Ordinances cited above, and the only fair and responsible way to <br /> proceed on this matter. <br />
