MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF MAY 21, 1971 <br /> The Dane County Board of Adjustment met on May 21, 1971 at 7:30 P. M. in <br /> Room 226 (Circuit Court Branch IV), to conduct a Public Hearing as <br /> published in the notice. <br /> Present: Erickson, Holte, Dahlk, Also: Enger, Fleck. <br /> Meeting was called to order, minutes of April 23 and May 15, 1971 were <br /> approved. Notice was read and the Public Hearing was opened. <br /> V #118. Appeal by C. Cox from denial of a permit to build an addition to <br /> a residence on a parcel of land located in the SW-1' NWT of Section <br /> 10, Township of Albion. Permit denied because rear yard is less <br /> than required by the Dane County Zoning Ordinance. <br /> IN FAVOR: Mr. Cox presented drawing, needs variance to finish <br /> building ad_iition. <br /> OTHERS IN FAVOR: none. OPPOSED: none. <br /> #119. Appeal by R. Sorenson from denial of a permit to build an <br /> addition to a residence on a parcel of land located in the rd.3.1= <br /> NE4 of Section 29, Township of Pleasant Springs. Permit denied <br /> because rear yard is less than required by the Dane County Zoning <br /> Ordinance. <br /> IN FAVOR: Mr. Sorenson stated other houses in area have same <br /> problem, some have existing porches which are too close to the <br /> rear line. <br /> OTHERS IN FAVOR: none. OPPOSED: none. <br /> TOWN BOARD: Chairman, David Manson, telephoned Zoning Department <br /> stating the Town Board has no objection to the appeal. <br /> v #120. Appeal by H. Spahn from denial of a permit to build a hay barn <br /> on a parcel of land located in the NE NWT of Section 31, <br /> Township of Springfield. Permit denied because setback from road <br /> is less than required by the Dane County Zoning Ordinance. <br /> IN FAVOR: Mr. Spahn presented drawing, stated that this is the <br /> only location he can build because of existing buildings and cow <br /> yard. If road were to be straightened in the future, would be <br /> willing to provide right of way on the opposite side. <br /> OTHERS IN FAVOR: none, OPPOSED: none. <br /> TOWN BOARD: John Laufenberg, Supervisor, stated that the Town <br /> Board had viewed the property. If the road were to be changed it <br /> would be moved further away from proposed barn. Board in favor of <br /> granting the appeal, <br /> ✓ #122. Appeal by R. Aton for a Speoial Exception Permit to build in the <br /> flood plain and also a variance in rear yard requirements, to <br /> permit construction of an addition to a residence located on a <br /> parcel of land in the SEX_ SE 1/4 of Section 22, Township of <br /> Mazomanie, <br /> IN FAVOR: R. Aton,left details to contractor, was unaware of rear <br /> yard requirements,or of the flood plain ordinance. <br /> OTHERS IN FAVOR: M. Walter, Supervisor District #47, presented <br /> drawing which showed that the property in question was <br /> approximately 6" below the road.At this point the road is not in <br /> the flood plain. Walter expressed concern over causing property <br /> owners to prove they are not within the flood plain area. River <br /> to date has not flooded this area and based on this and the <br /> possible error of the flood plain line, the appeal should be <br /> granted. <br /> A letter from Lee Pagel, property owner to the rear, was presented <br />
