DANE COUNTY BOARD OF ADJUSTMENT <br /> The Dane County Board of Adjustment met on April 17, 1970 at 7:30 P.M., <br /> in Room 226 (Circuit Court, Branch IV) to conduct a public hearing as <br /> published in the notice. The following members were present. Messrs. <br /> Erickson, Holte, Dahlk, Also present, Enger. <br /> Meeting called to order. Motion by Mr. Holte to adopt minutes of <br /> January 16 and April 14, 1970 meetings. Second by Mr. Erickson, <br /> carried. A letter from Hansen Advertising Company requesting with- <br /> drawal of their petition which was carried over from the last public <br /> hearing was read. Motion by Mr. Holte accepting withdrawal; second <br /> by Mr. Erickson, carried. <br /> Notice was read and the Public Hearing opened, the following cases were <br /> heard: <br /> 1. Appeal by John H. Osborne from the denial of a permit to build <br /> an addition to a building on Lots 3, !4 and 5, Block 3, Sunnyslope <br /> Addition, Town of Madison. Permit denied because rear yard is less <br /> than required by the Dane County Zoning Ordinance. <br /> IN FAVOR: Mr. Osborne presented a site plan which gave the location <br /> of his building and an adjacent building. He explained that he was <br /> requesting a rear yard of 1.6 feet, to add to the east side of the <br /> building would reduce much needed parking space. The adjacent building <br /> has a rear yard of 5 feet which was granted during the time the area <br /> was under extraterritorial zoning jurisdiction by the City of Madison. <br /> TIDSE OPPOSED: None <br /> TOWN BOARD: Don Pierstorff, Supervisor, said the town would be in favor <br /> of a 5 foot rear yard. <br /> 2. Appeal by Joe Sarbacker from the denial of a permit to build an <br /> addition to a barn on a parcel of land in the SW4 NW4 of Section 11, <br /> Town of Montrose. Permit denied because setback from highway is less <br /> than required by the Dane County Zoning Ordinance. <br /> IN FAVOR: Mr. Sarbacker explained that the 3 foot variance requested <br /> would provide enough barn space for his dairy herd. <br /> OPPOSED: None <br /> TOWN BOARD: Alfred Mellenberger had met with the Board of Adjustment <br /> at the time that the property was inspected and the town board had no <br /> objection. <br /> 3. Appeal by Rowan Nickolai from the denial of a permit to build <br /> a residence on Lot 12, Burr Oak Heights, Town of Roxbury. Permit denied <br /> because rear yard will be less than required by the Dane County Zoning <br /> Ordinance. <br /> IN FAVOR: Mr. Nickolai had a site plan of his proposed location. His <br /> plan did not show an adequate setback from the road. The lot being <br /> 100 feet deep did not permit a home of his design to be built on the <br /> lot. Mr. Nickolai agreed to the required setback of 30 feet, this <br /> would leave a rear yard of 40 feet as compared to the required 50 <br /> feet. <br /> OPPOSED: None <br /> TOWN BOARD: Did not appear. <br /> 11. Appeal by Rubert Kerl from the denial of a permit to build a barn on <br /> a parcel of land in the SV4 SW4 of Section 18, Town of Berry. Permit <br /> denied because setback from road is less than required by the Dane <br /> County Zoning Ordinance. <br />
