BOARD OF. ADJUSTM1'VI MEETING - APRIL 11, 1969 ,
The Dane County Board of Adjustment met at 7:30 P.N., April 11,
1969 in Room 226 (Circuit Court Branch IV), City-County Building,
Madison, Wisconsin to conduct a public hearing as published in
the notice. The following members were present: Millard Erickson,
Chairman; Oscar Holte, Vice-Chairman; Hermann Eisner, Secretary.
Also present ; I . J. Enger, Zoning Assistant.
The meeting was called to order. Minutes of the meetings of
March 28, 1969 and April 5, 1969 were adopted. The notice was
read and the following cases heard:
1. Appeal by Lee Steward from the denial of a permit to build a
- - duplex on a parcel of land in the ,'i NE',,1 of Section 28, Town of
• Burke. Permit denied because set back from road and rear yard is
less than required by Dane County Zoning Ordinance.
THOSE IN FAVOR: Mr. Steward explained his plans to sell the land
to another party for the purpose of building a duplex but the lot
is long and narrow so a variance would have to be granted in order
to build on it. It was suggested that the front be taken toward
Portage Road and that the north and south sides of the lot would
then be side yards and by taking a 10 foot side yard to the south
a variance in the set back from David .Road of 2 feet would be
required. This was agreeable to Mr. Steward.
THOSE OPPOSED: Mr. Don Ruland, a neighbor brought a letter from
a Mr. Fuzzard which was read. Their objection was mostly that the
land in question was not in the City of Madison and they felt that
if it were annexed to the City that the chances of getting sewer
service would be better. They also objected to multiple, family
units. It was explained that under A-1 Zoning, multiple family
housing is permitted and that the Board of Adjustment could not
make a restriction on a permitted use of the land. .
TOWN BOARD: Mr. 0. K. Anderson, Chairman appeared in favor of
' granting the variance.
ACTION BY THE BOARD: Mr. Eisner moved to grant a variance of
2 feet in set back from David Road, Mr. Holte seconded and the
vote was unanimous. - -
2. Appeal by Conrad J. Breunig from the denial of a permit to
build a feed bunk and a parcel of land in the SEI,-i SE',i of Section
27, Town of Roxbury. Permit denied because set back from highway
12 is less than required by Dane County Zoning Ordinance.
THOSE IN FAVOR: Mr. Breunig explained that because of the location
of other buildings, this is about the only location that can be
used. Two other buildings which had been built before a set back
•
was required are closer to the road.
THOSE OPPOSED: None
TOWN BOARD: The Town Board is in favor of granting the variance.
Cri
••
ACTION BY THE BOARD: Mr. Holte moved to grant the variance, Mr.
Eisner seconded and the vote was unanimous.
