BOARD OF ADJUSTMENT MEETING - AUGUST 1, 1969 <br /> The Dane County Board of Adjustment met at 7:30 P.M., August 1, 1969 in <br /> Room 226 (Circuit Court Branch IV), City-County Building, Madison, Wisconsin <br /> to conduct a public hearing as published in the notice. The following members <br /> were present: Millard Erickson, Oscar Holte, Hermann Eisner. Also present: <br /> L. J. Enger, Zoning Assistant. <br /> The meeting was called to order; the minutes of the meetings of July 18 and <br /> 26 were adopted. The notice was read and the following cases heard: <br /> 1. Appeal by David F. Brauch from the denial of a permit to build a residence <br /> on Lot 34, Riverview Garden Estates Subdivision, Town of Westport. Permit <br /> denied because set back from road is less than required by the Dane County <br /> Zoning Ordinance. <br /> THOSE IN FAVOR: David Brauch appeared and stated that the reason for asking <br /> for a variance on the south end of his house was to stay far enough from an <br /> oak tree to the east so that he would not endanger it. He had asked for a <br /> variance of nine feet but had reduced the depth of the house so that now he <br /> is asking for a set back of 22 feet and a variance of 8 feet. Michael P. <br /> Simon, builder and developer of the subdivision also appeared and was in <br /> favor of the variance. <br /> THOSE OPPOSED: Allan Schwahn, owns and occupies the home on Lot 33. He feel& <br /> that to grant the variance would destroy his view of the Capitol building. <br /> He also has an M.S. in Ecological Biology and does not feel that building <br /> at the required set back would have any effect on the oak tree in question. <br /> Mr. Erickson questioned this statement since he has had wide experience <br /> as a farmer, developer and town chairman and his experience has always been <br /> that to disturb an oak tree would mean that it would die. <br /> TOWN BOARD: Did not appear. <br /> Mr. Eisner moved that the Board adjourn until 8:00 A.M. on August 2, to <br /> make another inspection of the property to determine the effect that <br /> granting the variq,nace would have on Mr. Schwahn's view. <br /> Meeting adjourned at 8:10 P.M. <br /> Mileage: All regular <br /> Secretary, Hermann Eisner . o_ ,(%)7 ' <br />
