1 <br /> BOARD OF ADJUSTMENT HEARING, June 28, 1968 <br /> The Dane County Board of Adjustment met in Room 226, City-County Building <br /> Madison, Wisconsin at 7:30 P.M., June 28, 1968 to conduct a hearing as <br /> published in the notice. The following members of the Board were present: <br /> 0. K. Anderson, Chairman; Millard Erickson, Vice-Chairman; Hermann Eisner, <br /> Secretary. Also present; L. J. Enger, Zoning Assistant; Mr. James Tierney, <br /> Chairman of the Town of Westport. <br /> The meeting was called to order, notice read and the following cases called <br /> 1. Appeal by Frederick Schlimgen from a denial of a permit to build a <br /> garage on Lot 2, Block 3, Morris Park, Section 33, Town of Westport. <br /> Permit denied because set back from road is less than required by Dane <br /> County Zoning Ordinance. <br /> THOSE IN FAVOR: Mr. Schlimgen explained plans to remove present 1 stall <br /> garage and replace it with a 2 stall garage which will be set farther in <br /> on his lot and will permit parking off of the road right of way. Mr. Tierne <br /> said that the Town Board of Westport was in favor of the variance. <br /> THOSE OPPOSED: None <br /> ACTION BY THE BOARD: Mr. Eisner moved and Mr. Erickson seconded and the <br /> vote was unanimous for approval. <br /> 2. Appeal by Lloyd Krebs from a denial of a permit to build a silo on a <br /> parcel of land in the SEi of the NE% of Section 34, Town of Bristol. Permit <br /> denied because setback from road is less than required by Dane County <br /> Zoning Ordinance. <br /> THOSE IN FAVOR: Mr. Lloyd Krebs told of his plans to build an addition <br /> to his barn and that this was about the most practical location for the <br /> silo, the silo would be located farther from the right of way of the road <br /> than a non-conforming milk house. Neither he nor the contractor had realized <br /> that a set back from the right of way was required when the footings were <br /> poured. Mr. Hanley appeared and stated he was not opposed to the variance <br /> but there was some question over future highway needs; it was explained <br /> that the right of way is already 66 feet in width. The Town of Bristol <br /> did not appear but Mr. Burnson, Chairman had told Mr. Krebs and Mr. <br /> Erickson that he was not apposed. <br /> THOSE OPPOSED: None appeared, but Mr. Swann of the Highway Department had <br /> contacted the Zoning Office by telephone and said that he was opposed. <br /> ACTION BY THE BOARD: Mr. Erickson moved and Mr. Anderson seconded that <br /> the approval be granted, the vote was Mr. Erickson and Mr. Anderson in <br /> favor with Mr. Eisner voting against. Mr. Eisner felt that in granting <br /> this variance would set a precedent in the area. <br /> 3. Appeal by Mrs. Linka Kempf was withdrawn by a letter to the Board dated <br /> June 25, 1968. <br /> OTHER BUSINESS: Mr. Eisner moved that the meeting be adjourned until <br /> Wednesday, July 3, 1968 at 7:30 P.M. for organization of the new Board; <br /> Mr. Erickson seconded and the vote was unanimous. Mr. Eisner also asked <br /> that Mr. Massarene be present at the organization meeting, it was explained <br /> that he was on vacation and would not return until July 8. <br /> Meeting adjourned at 8:15 P.M. <br /> / <br /> Secretary, Hermann Eisner�(�/,�, 1 � �? y <br />
