BOARD 07 APJUSTKENT HEARING <br /> '`Il G <br /> June 1, 1967 <br /> The following members were present: Chairman, Kartin J. Riap; Secretary, <br /> Hermann Eisner, and C. K. fladerson. <br /> The Hearing was called to order at 7:30 o'clock P. P . by the Chairman and <br /> Air. Eisner read the notice. <br /> 1. Appeal from the denial of a permit for an Addition to a Single Family <br /> Residence by Thomas G. Bricker on Lot 7 Camp Columbia which is in Section 25, <br /> Town of Dunn. Permit denied for the reason that the east side yard is less <br /> than ordinance reouirements. Kr. Pricker appeared and stated that there is <br /> only one bedroom for himself, his wife and 12 year old son. He felt that it <br /> was a hardship, as it now stood, and would like to have approval in order that <br /> he could build two bedrooms: one on the first floor and one on the second. <br /> OTHERS IN _SVCR: none <br /> OPPOSITION : Frederick P. ':,'ilcox, who lives on Lot 8, spoke at length about <br /> his financial and ecstatic interest in the "50 or 60 year old plat." He ex- <br /> plained about a verbal site-line-agreement which the developer and various <br /> owners in the plat had accepted. He also stated that the view from his home <br /> would be blocked to the southeast, if Bricker's addition were allowed. And- <br /> rew Dahlen, owner of Lot 10, came forward and advised that it was an oral agree- <br /> ment only, but felt that the lake "line-of-site-view" would be broken up if <br /> Bricker's addition were allowed. <br /> TCJN BOARD: Chairman, Hartman Olson, Kilo Edwards, and Sid i-Ianson were present <br /> and Olson stated that, "I don't feel that we can object on the grounds of a <br /> verbal agreement which does not involved the zoning ordinance or a deed re- <br /> striction; therefore, the Town Board wished to be recorded in favor." <br /> 2. Appeal from an order to cease construction of a Single Family Residence <br /> being built by Hichael Simon for Charles Johnson on Lot 2, Flock 1, Trantin <br /> Subdivision (Borchers Beach Road P Simon Trail) which is in Section 33, Town <br /> of Westport. Building permit number 15227, which Simon took out, stated a 40 <br /> foot setback from the dedicated and total 66 foot right of way of Borchers <br /> Beach Road. The building, its foundation is completed, is only 22y' feet from <br /> said right of way. Eichael Simon appeared and stated that he was trying to <br /> satisfy the owner, but made a mistate and co mitted the violation. He advised <br /> further that he was trying to save trees and the view of the lake. He felt <br /> that with the 22Y2 foot setback from the close portion, the garage, there was <br /> still room for a car to be parked in front without projecting into the right <br /> of way. <br /> OTHERS IF FAVOR: J. L. Anderson of Route 1, '.launakee appeared and spoke. He <br /> stated that he realized that Kr. Simon had violated the provisions of the per- <br /> mit, but that he also felt that the house was placed in the only feasible pos- <br /> ition on the lot. He asked the Board to consider the Quality of the homes in <br /> the area which Simon had built. Later, he mentioned drainage fields etc. , but <br /> this was not specific to the situation. <br /> CIE-CSITICN: none <br /> TdAS BO ,RD: Chairman, James Tierney, and Bernard J.
