BOARD OF ADJUSTMENT, HEARING: March 8, 1967
Members present: Martin J. Ripp and 0. K. Anderson
Mr. Eisner was unable to attend because of a
County Board Meeting.
The Hearing was called to order at 7:35 p, m. and Mr. Anderson read the
notice of Public Hearing.
1. Appeal from the denial of a permit for a Garage (moving and foundation)
on a parcel in Government Lot 4, Section 23, Town of Dunn (Colladay Drive).
Permit denied for the reason that one side yard is less than ordinance require-
ments. Neigher Mr. or Mrs. Jack Kriedeman were present and so this matter was
passed for the time being.
2. Appeal from the denial of a permit for an Addition to a Residence on
a parcel in the NE1ia NW4, Section 23, Town of Dunn (County Trunk "AB"). Per-
mit denied for the reason that one side yard is less than ordinance require-
ments. Mr. and Mrs. Aorman G. Severson were present and showed a diagram
and artists pictorial illistration of the house after the 10 x 20' porch add-
ition. The addition would be put on the front-northwest corner of existing
structure.
Others in favor: none
Those against: none
Town Chairman, Hartman Olson, sideboard member, Sid Hanson, and Clerk, Char-
les Barber were present and registered themselves in favor.
3. Appeal from the denial of a permit for a Change in Use from a school
to a Residence, and the Moving and Foundation for another Residence compris-
inga total of four apartment units, the site being in the NW's SW , Section 29
and the NEi;4 SE'; , Section 30, Town of Westport (Chicken Road). Permit denied
for the reason that area and setback are less than ordinance requirements.
Leo Herbrand, the applicant, and Ralph Pongratz appear and speak in favor.
We are now advised that the old house, see diagram in display, folder, to be
moved in would be remodeled only into a single family residence instead of
a two apartment structure. This being the case, the 19,008 sq. ft. would
be ample for a total of three living units in A-1 Agricultural zoning, where
public sewer is not availiable. Discussion brought out that the sills of
the old Blackwood school were rotted, the structure has very high windows
and the outside stucco-brick was in poor condition. In addition there is
only a 14' setback, notwithstanding the removal of a 5 x 9' entry way. Mr.
Herbrand stated that he would raise the floor, install two separate stair-
ways at each end of old school, replace the windows and refinish the outer
walls in some manner. Mr. Benway advised that the moving and foundation
for the single family residence could not be oppossed by the Board of Ad-
justment in its association with the County `oning Ordinance, but should
a permit for it be issued fax it by the County, it would in no way pre-
clude the Town of Westport from denying trieir permit for it, should it not
meet the Town building code.
Other8 in favor: none
Those in oppossition: dames Tierney advised that he had no objection to
remodeling the school as it would be an improvement, but was against mov-
ing in the old house which belongs to Mr. ilerbrand's mother-in-law. Mr.
and Mrs. Richard Ziegler and son appeared and she spoke: "I object to the
