Board of Adjustment - Minutes - Page 2 <br /> #494. IN FAVOR: Arnold Turk, Builder - representing Mrs. Roe, - OPPOSED <br /> None <br /> #495. IN FAVOR: Marvin J. Harms - OPPOSED: None <br /> The Public Hearing was closed. <br /> #463. Motion by Voges second by Dahlk to waive appearance requirement and <br /> grant variance of 27 feet from setback required as per finding of fact: <br /> 1. Addition will be to rear of residence. <br /> 2. Residence is non-conforming as to setback <br /> CONCLUSION: <br /> A. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #480. Motion by Dahlk second by Voges to hold in abeyance for additional <br /> information. Decision to be rendered within two weeks. Motion carried. <br /> r <br /> #481. Motion by Voges, second by Dahlk to grant a variance of 15 feet <br /> from setback from centerline of U.S.H. 12 as per finding of fact: <br /> 1. Highway 12 is straight in this location and proposed building will <br /> be located farther off the road than existing buildings. <br /> 2. Other location would be away from farm work yard, and natural gas <br /> line. Gas line to another location would require tearing up black- <br /> top drive. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #482. Motion by Dahlk second by Voges to grant a variance of 6 feet <br /> from right side yard as per finding of fact: <br /> 1. Garage cannot be located to left of house because of bulk gas tank <br /> and wooded area - nor to the rear because of septic field. <br /> 2. Bedrooms are on right side of house and attaching garage would <br /> block the windows. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B.
