Driveway, continuing through the property to the farm, septic <br /> and orchard prevent other location of garage. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #484. Motion by Dahlk, second by Voges to grant an 8 1/2 foot variance <br /> from right side yard as per finding of fact: <br /> 1. Lots were created after residences were built, creating many non- <br /> conformities. <br /> • 2. Neighbors house, to the right, is approximately 35 feet away. <br /> 3. Additions would not increase the non-conformity. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> . B. Variance is necessary to provide right enjoyed by others. <br /> C. Motion by Voges, second by Dahlk to waive appearance requirement <br /> and grant a variance of 38 feet from setback from centerline of CTH C <br /> as per finding of fact: <br /> 1. Existing residence is non-conforming as to setback. <br /> 2. Addition will be located farther back than front line of residence. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #486. Motion by Dahlk, second by Voges to grant a 4 foot variance from <br /> left side yard and a 1,318 sq. foot variance from maximum area allowed as <br /> • <br /> per finding of fact: <br /> 1. Existing accessory building would have to be torn down to make <br /> conforming. <br /> 2. Additional space is required for storage of antique trucks - a smaller <br /> garage would not provide enough room. <br /> 3. Accessory building will not be utilitzed for commercial purposes. <br /> CONCLUSION: <br /> A. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> B. Variance is not contrary to rights of others or to the public <br /> interest. <br /> C. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br />
