Board of Adjustment - Minutes - Page 4 <br /> #487. Motion by Voges, second by Dahlk to deny appeal as per finding of <br /> 1 fact: <br /> 1. First inspection whey error in location would have been caught, <br /> was not requested by contractor. <br /> 2. Garage could be located in a conforming location on the property. <br /> CONCLUSION: <br /> A. No hardship involved. <br /> Motion carried. <br /> #488. Motion by Dahlk, second by Voges to grant the special exception <br /> permit with the following conditions: <br /> 1. Spoil, if any, must be spread on lands away from creek. <br /> 2. Graded areas and disturbed banks of creek shall be seeded to pre- <br /> vent erosion. <br /> 3. Size of culvert shall be determined by DNR. <br /> Motion carried. <br /> • <br /> #489. Motion by Voges, second by Dahlk to grant the special exception <br /> permit as proposed. Motion carried. <br /> #490. Motion by Dahlk second by Voges to grant a variance of gl feet from <br /> center-line of CTH D (Fish Hatchery Road) as per finding of fact: <br /> 1. Existing building is non-conforming as to setback. <br /> 2. Addition will be to rear of building and will not increase the <br /> non-conformity. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #491. Motion by Voges, second by Dahlk to grant variance of 22 feet from <br /> right-of-way of CTH S (Mineral Point Road) as per finding of fact: <br /> 1. Existing building is non-conforming as to setback. <br /> 2. Additions are to rear and the addition in front will not exceed <br /> the building lines; therefore there will be no increase in non- <br /> conformity. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #492. Motion by Dahlk, second by Voges to waive appearance and grant the <br /> AL <br /> special exception with the following conditions: <br /> 1. Spoil shall be dispersed and leveled on lands away from creek. <br /> 2. Banks of ditch/ponds shall be seeded to prevent erosion. <br /> 3. Ditch/ponds shall not be connected to creek. <br /> Motion carried. <br />
