Board of Adjustment - Minutes - Page 5 <br /> #493. Motion by Dahlk, second by Voges to grant a 9 foot variance from <br /> setback from centerline of C.T.H. "MM" as per finding of fact: <br /> 1. Existing residence is non-conforming as to setback. <br /> 2. Addition in other location is not feasible because of driveway <br /> and topography of land. <br /> CONCLUSION: <br /> A. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or'to the public <br /> interest. <br /> Motion carried. <br /> . #494. Motion by Voges second by Dahlk to grant variance of 7 feet from <br /> setback from normal high water line as per finding of fact: <br /> 1. There will be no external additions to residence. <br /> 2. Many other residences in area are also too close to lake. <br /> • <br /> 3. Residence was in existance before ordinance was effective. <br /> CONCLUSION: <br /> A. Proven case of.unnecessary hardship. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> D. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #495. Motion by Dahlk second by Voges to grant variance of 23 1/2 feet <br /> from setback from normal high water line and 14 feet from setback from <br /> right-of-way on U.S.H. 51 as per finding of fact: <br /> 1. Residence was in existance before ordinances were effective. <br /> 2. Walkway/deck is to provide access for second door on residence. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> C.
